4 Canada Gazette Part I STATEMENT OF ROYALTIES TO BE COLLECTED BY THE NEIGHBOURING RIGHTS COLLECTIVE OF CANADA (NRCC) FOR THE PUBLIC PERFORMANCE OR THE COMMUNICATION TO THE PUBLIC BY TELECOMMUNICATION, IN CANADA, OF PUBLISHED SOUND RECORDINGS EMBODYING MUSICAL WORKS AND PERFORMER’S PERFORMANCES OF SUCH WORKS IN 1998, 1999, 2000, 2001 AND 2002 GENERAL PROVISIONS All ro yalties payable under this tariff are exclusive of any fed-eral, provincial or other governmental taxes or levies of any kind. Tariff No. 1 RADIO A. Commercial Radio Short Title 1. This tariff ma y be cited as the Neighbouring Rights Com-mercial Radio Tariff, 1998-2002. Definitions 2. In this tariff, “Act” means the Copyright Act; “advertisin g revenues” has the meaning ascribed to this expres-sion b y the Regulations Defining “Advertising Revenues”, SOR 98-447, Canada Gazette Part II, Vol. 132, No. 19, p. 2589; “all-talk station” means a station which (a) devotes its entire dail y programming schedule to spoken word programming and plays only production music during the reference month, and (b) kee ps and makes available to NRCC complete recordings of its last 90 broadcast da ys; “low-use station” means a station that (a) broadcasts works in the re pertoire of the Society of Com posers, Authors and Music Publishers of Canada (SOCAN) for less than 20 per cent of its total broadcast time (excludin g production music) during the reference month, and (b) kee ps and makes available to NRCC complete recordings of its last 90 broadcast da ys; “ production music” means music used in interstitial programming such as commercials, public service announcements and jingles; “reference month” means the second month before the month for which ro yalties are being paid; “ year” means a calendar year. Application 3. This tariff sets the ro yalties to be paid each month by com-mercial radio stations, pursuant to section 19 of the Act, as equi-table remuneration for the communication to the public by tele-communication of published sound recordings of musical works. 4. This tariff is sub ject to the special and transitional royalty rates set out in subsection 68.1(1) of the Act. Royalties 5. (1) An all-talk station shall pay $100. Application 3. Le présent tarif est assujetti aux tarifs spéciaux et transitoires prévus au paragraphe 68.1(1) de la Loi. Redevances 5. (1) Une station de radio parlée verse 100 $.

(3) An y other station shall pay 1.44 per cent of its advertising revenues during the reference month. ADMINISTRATIVE PROVISIONS 6. No later than the first da y of each month, the station shall pay the royalties for that month and report the station’s advertis-in g revenues for the reference month. Sound Recording Use Information 7. (1) U pon receipt of a written request from NRCC, a station shall provide to NRCC, with respect to all sound recordings broadcast b y the station during the days selected by NRCC: (a) the date and time of broadcast; (b) the title of the sound recordin g, the name of the performers and/or performing groups and the record label. (2) The information shall be provided in electronic format where possible, otherwise in writing, no later than 14 days after the end of the month to which the y relate. (3) NRCC ma y request information pursuant to subsection (1) with res pect to no more than 14 days in any given year. Accounts and Records 8. (1) A station shall kee p and preserve, for a period of six months after the end of the month to which the y relate, records from which NRCC can readil y ascertain information requested pursuant to section 7. (2) A station shall kee p and preserve, for a period of six years after the end of the year to which they relate, records from which NRCC can readil y ascertain the station’s advertising revenues. (3) NRCC ma y audit these records at any time during the pe-riod set out in subsection (1) or (2), as well as the broadcast da y recordings of an all-talk station or a low-use station, on reason-able notice and durin g normal business hours. (4) If the audit of a station discloses that the ro yalties due to NRCC have been understated in an y month by more than ten per cent, the station shall pay the reasonable costs of audit within 30 da ys of the demand for such payment. Confidentiality 9. (1) Sub ject to subsections (2) and (3), NRCC shall treat in confidence information received from a station pursuant to this tariff, unless the station consents in writin g to the information bein g treated otherwise. (2) NRCC ma y share information referred to in subsection (1) (i) with the Co pyright Board; (ii) in connection with proceedings before the Copyright Board; (iii) to the extent re quired to effect the distribution of royalties, with an y other collecting body or with its royalty claimants; or (iv) if ordered b y law or by a court of law. (3) Subsection (1) does not a pply to information that is pub-licl y available, or to information obtained from someone other than the station, who is not under an a pparent duty of confiden-tialit y to the station.Gazette du Canada Partie I 5 (2) Une station à faible utilisation verse 0,64 pour cent des re-cettes publicitaires qu’elle a perçues durant le mois de référence. Renseignements sur l’utilisation d’enregistrements sonores 7. (1) Sur demande écrite de la SCGDV, la station lui fournit les rensei gnements suivants à l’égard de tous les enregistrements sonores qu’elle a diffusés durant les jours choisis par la SCGDV : a) la date et l’heure de la diffusion; b) le titre de l’enre gistrement, le nom des artistes-interprètes ou groupes d’interprètes et celui de la maison de disque. (2) La station fournit les rensei gnements au plus tard 14 jours a près la fin du mois auquel ils se rapportent, si possible sous forme électroni que et sinon, par écrit. (3) La SCGDV peut demander les renseignements prévus au paragraphe (1) à l’égard de 14 jours par année. Registres et vérifications 8. (1) La station tient et conserve durant six mois après la fin du mois au quel ils se rapportent les registres permettant à la SCGDV de déterminer facilement les rensei gnements demandés au titre de l’article 7. (4) Si la vérification des registres d’une station révèle que les redevances ont été sous-estimées de plus de dix pour cent pour un mois quelconque, la station assume les coûts raisonnables de la vérification de ce s ystème dans les 30 jours suivant la date à la quelle on lui en fait la demande. Traitement confidentiel 9. (1) Sous réserve des paragraphes (2) et (3), la SCGDV garde confidentiels les rensei gnements qu’une station lui transmet en a pplication du présent tarif, à moins que cette dernière ne con-sente par écrit à ce qu’ils soient divulgués. (2) La SCGDV peut faire part des renseignements visés au paragraphe (1) (i) à la Commission du droit d’auteur; (ii) à toute personne, dans le cadre d’une affaire portée devant la Commission; (iii) à une autre société de gestion ou à une personne qui de-mande le versement de droits, dans la mesure où cela est néces-saire pour effectuer la distribution; (iv) si la loi ou une ordonnance d’un tribunal l’ y oblige. (3) Le paragraphe (1) ne s’applique pas aux renseignements dis ponibles au public ou obtenus d’un tiers non tenu lui-même de garder confidentiels ces renseignements.

Ad justments in the amount of royalties owed by a station (includin g excess payments), as a result of the discovery of an error or otherwise, shall be made on the date the station’s next ro yalty payment is due. Interest on Late Payments 11. An y amount not received by the due date shall bear interest calculated monthl y on the last day of each month, at the Bank Rate effective on that da y (as published by the Bank of Canada) plus one percent. Interest shall not compound. Addresses for Notices, etc. 12. (1) An ything that a station sends to NRCC shall be sent to 540 Mount Pleasant Road, Suite 203, Toronto, Ontario M4S 2M3, or to an y other address of which the station has been notified. (2) An ything that NRCC sends to a station shall be sent to the last address of which NRCC has been notified. Delivery of Notices and Payments 13. (1) A notice may be delivered by hand, by postage paid mail or b y telecopier. (2) A notice or payment mailed in Canada shall be presumed to have been received three business da ys after the day it was mailed. (3) A notice sent b y telecopier shall be presumed to have been received the da y it is transmitted. Transitional Provisions 14. (1) An y amount payable for any given month before Octo-ber 1999 shall be due on Se ptember 31, 1999, and shall be in-creased b y using the multiplying factor set out in the following table with respect to that month. (1) Les redevances exi gibles pour tout mois précédant le mois d’octobre 1999 sont ac quittées le 31 septembre 1999 et sont ma jorées en utilisant le facteur établi à l’égard de ce mois dans le tableau qui suit.
