Statement of Royalties to Be Collected by SOCAN for the
Communication to the Public by Telecommunication, in Canada,
of Musical or Dramatico-Musical Works
In accordance with subsection 68(4) of the Copyright Act, the
Copyright Board has certified and hereby publishes the statement
of royalties to be collected by the Society of Composers, Authors
and Music Publishers of Canada (SOCAN) for the communica-
tion to the public by telecommunication, in Canada, of musical or
dramatico-musical works in respect of Tariff 23 (Hotel and Motel
In-Room Services) for the years 2001 to 2006.

Conformément
au
paragraphe
68(4)
de
la
Loi
sur
le
droit
d’auteur, la Commission du droit d’auteur a homologué et publie
le tarif des redevances que la Société canadienne des auteurs,
compositeurs et éditeurs de musique (SOCAN) peut percevoir
pour la communication au public par télécommunication, au Ca-
nada, d’œuvres musicales ou dramatico-musicales, à l’égard du
tarif 23 (Services offerts dans les chambres d’hôtel et de motel)
pour les années 2001 à 2006.

SOCIETY OF COMPOSERS, AUTHORS AND MUSIC
PUBLISHERS OF CANADA (SOCAN) FOR THE
COMMUNICATION TO THE PUBLIC BY
TELECOMMUNICATION, IN CANADA,
OF MUSICAL OR DRAMATICO-MUSICAL WORKS
FOR THE YEARS 2001 TO 2006
GENERAL PROVISIONS
All royalties payable under this tariff are exclusive of any fed-
eral, provincial or other governmental taxes or levies of any kind.
Every SOCAN licence shall subsist according to the terms set
out therein. SOCAN shall have the right at any time to terminate a
licence for breach of terms or conditions upon 30 days notice in
writing.
Tariff No. 23
HOTEL AND MOTEL IN-ROOM SERVICES
Definitions
1. In this tariff, “mature audience film” means an audio-visual
work that has sexual activity as its primary component and that is
separately marketed as adult entertainment.
Application and Royalties
2. For a licence to communicate to the public by telecommuni-
cation, at any time and as often as desired in the years 2001 to
2006, any or all of the works in SOCAN’s repertoire, by means of
hotel or motel in-room audio-visual or musical services, the total
fees payable shall be
(a) 1.05% in 2001, 1.10% in 2002, 1.15% in 2003, 1.20% in
2004, and 1.25% in the years 2005 and 2006, of the fees paid
by guests to view audio-visual works other than mature audi-
ence films;
(b) 0.2625% in 2001, 0.275% in 2002, 0.2875% in 2003, 0.3%
in 2004, and 0.3125% in the years 2005 and 2006, of the fees
paid by guests to view mature audience films containing any
work in respect of which a SOCAN licence is required; and
(c) 5.0% in the years 2001 and 2002, and 5.5% in the years
2003 to 2006, of the revenues of the provider of any musical
service.
Payment and Reporting Requirements
3. Royalties shall be due no later than 60 days after the end of
each
quarter.
The
payment
shall
be
accompanied
by
a
report
showing, with respect to the relevant quarter,
(a) for audio-visual works other than mature audience films,
(i) the fees paid by guests to view the audio-visual content,
and
(ii) the individual titles of the audio-visual works used dur-
ing the quarter,
(b) for mature audience films,
(i) the fees paid by guests to view the films,
(ii) a list of individual titles of the films used during the
quarter, indicating which films did not contain any work in
respect of which a SOCAN licence is required, and
(iii) if a film does not contain any work in respect of which a
SOCAN licence is required, documentation establishing that
no such works were used;
(c) for musical services,

Les redevances exigibles en vertu du présent tarif ne compren-
nent ni les taxes fédérales, provinciales ou autres, ni les autres
prélèvements qui pourraient s’appliquer.
Chaque licence de la SOCAN reste valable en fonction des
conditions qui y sont énoncées. La SOCAN peut, en tout temps,
mettre fin à toute licence sur préavis écrit de 30 jours pour viola-
tion des modalités de la licence.

SERVICES OFFERTS DANS LES CHAMBRES
D’HÔTEL ET DE MOTEL
Définitions
1. Dans le présent tarif, « film pour adultes » s’entend d’une
œuvre audiovisuelle visant avant tout à représenter des activités
de nature sexuelle et qui est mise en marché en tant que divertis-
sement pour adultes.
Application et redevances
2. Pour une licence permettant la communication au public par
télécommunication,
en
tout
temps
et
aussi
souvent
que
désiré
durant les années 2001 à 2006, de l’une ou de la totalité des œu-
vres faisant partie du répertoire de la SOCAN, dans le cadre de
services
audiovisuels
ou
musicaux
offerts
dans
une
chambre
d’hôtel ou de motel, le montant total des redevances est le suivant :
a) 1,05 % en 2001, 1,10 % en 2002, 1,15 % en 2003, 1,20 % en
2004, et 1,25 % en 2005 et 2006, des sommes versées par un
client pour visionner une œuvre audiovisuelle autre qu’un film
pour adultes;
b) 0,2625 % en 2001, 0,275 % en 2002, 0,2875 % en 2003,
0,3 % en 2004, et 0,3125 % en 2005 et 2006, des sommes ver-
sées
par
un
client
pour
visionner
un
film
pour
adultes
qui
contient une œuvre nécessitant une licence de la SOCAN;
c) 5,0 % en 2001 et 2002, et 5,5 % durant les années 2003 à
2006, des recettes du fournisseur d’un service musical.
Obligations de paiement et de rapport
3. Les redevances sont payables au plus tard 60 jours après la
fin de chaque trimestre. Le paiement est accompagné d’un rapport
indiquant, pour le trimestre pertinent :
a) à l’égard des œuvres audiovisuelles autres que les films pour
adultes :
(i)
les
sommes
versées
par
des
clients
pour
visionner
le
contenu audiovisuel,
(ii)
le
titre
des
œuvres
audiovisuelles
utilisées
durant
le
trimestre;
b) à l’égard des films pour adultes :
(i) les sommes versées par des clients pour visionner un film,
(ii) le titre des films utilisés durant le trimestre, avec une in-
dication des films ne contenant aucune œuvre nécessitant
une licence de la SOCAN,
(iii) si un film ne contenait aucune œuvre nécessitant une li-
cence de la SOCAN, la documentation établissant que tel
était le cas;

(i) the fees paid by guests to use the service,

(iii) the Universal Product Code (UPC) and the International
Standard Recording Code (ISRC) of the recordings used in
providing the service.
Audits
4. SOCAN shall have the right to audit the licensee’s books
and records, on reasonable notice and during normal business
hours, to verify statements rendered and the fee payable by the
licensee.
Uses Not Targeted in the Tariff
5.
(1)
This
tariff
does
not
apply
to
uses
covered
by
other
SOCAN tariffs, including Tariffs 17 and 22 and the SOCAN-
NRCC Pay Audio Services Tariff.
(2) This tariff does not apply to Internet access services or to
video games services.
Transitional Provision
6. The reporting requirements set out in section 3 apply only
from July 1, 2006.

Vérifications
4. La SOCAN peut vérifier les livres et registres du titulaire de
la licence durant les heures de bureau régulières, moyennant un
préavis raisonnable, afin de confirmer les rapports soumis par le
titulaire de la licence et la redevance exigible de ce dernier.
Utilisations non visées par le tarif
5. (1) Le présent tarif ne vise pas les usages assujettis à d’autres
tarifs de la SOCAN,

compris les tarifs 17 et 22 et le tarif
SOCAN-SCGDV applicable aux services sonores payants.
(2) Le présent tarif ne vise pas les services d’accès à l’Internet
ou les services offrant des jeux vidéo.
Disposition transitoire
6. Les obligations de rapport énumérées à l’article 3 s’appli-
quent uniquement à partir du 1
er
juillet 2006.
