4 Supplement to the Canada Gazette STATEMENT OF ROYALTIES TO BE COLLECTED BY THE NEIGHBOURING RIGHTS COLLECTIVE OF CANADA (NRCC) FOR THE COMMUNICATION TO THE PUBLIC BY TELECOMMUNICATION, IN CANADA, OF PUBLISHED SOUND RECORDINGS EMBODYING MUSICAL WORKS AND PERFORMER’S PERFORMANCES OF SUCH WORKS IN 2003, 2004 AND 2005 GENERAL PROVISIONS All royalties payable under this tariff are exclusive of any fed- eral, provincial or other governmental taxes or levies of any kind. Tariff No. 1 RADIO C. Canadian Broadcasting Corporation (2003-2005) Application 1. This tariff sets the royalties to be paid each month by the Canadian Broadcasting Corporation (CBC), pursuant to sec- tion 19 of the Copyright Act, as equitable remuneration for the communication to the public by telecommunication of published sound recordings embodying musical works and performer’s per- formances of such works by over-the-air radio broadcasting. Royalties 2. CBC shall pay NRCC $80,000 per month, on the first day of each month. Interest on Late Payments 3. Any amount not received by the due date shall bear interest from that date until the date the amount is received. 4. Interest shall be calculated daily at a rate equal to one per- cent above the Bank Rate effective on the last day of the previous month (as published by the Bank of Canada). Interest shall not compound. Delivery of Notices and Payments 5. (1) A notice may be delivered by hand, by postage paid mail or by facsimile. (2) A notice or payment mailed in Canada shall be presumed to have been received three business days after the day it was mailed. (3) A notice sent by telecopier shall be presumed to have been received the day it is transmitted. Music Use Information 6. CBC shall provide to NRCC the music use information that it supplies to the Society of Composers, Authors and Music Pub- lishers of Canada. January 15, 2005 TARIF DES REDEVANCES À PERCEVOIR PAR LA SOCIÉTÉ CANADIENNE DE GESTION DES DROITS VOISINS (SCGDV) POUR LA COMMUNICATION AU PUBLIC PAR TÉLÉCOMMUNICATION, AU CANADA, D’ENREGISTREMENTS SONORES PUBLIÉS CONSTITUÉS D’ŒUVRES MUSICALES ET DE LA PRESTATION DE TELLES ŒUVRES EN 2003, 2004 ET 2005 DISPOSITIONS GÉNÉRALES Les redevances exigibles en vertu du présent tarif ne compren- nent ni les taxes fédérales, provinciales ou autres, ni les prélève- ments d’autre genre qui pourraient s’appliquer. Tarif n o 1 RADIO C. Société Radio-Canada (2003-2005) Application 1. Le présent tarif établit les redevances payables à chaque mois par la Société Radio-Canada (SRC), conformément à l’arti- cle 19 de la Loi sur le droit d’auteur, à titre de rémunération équi- table pour la communication au public par télécommunication d’enregistrements sonores publiés constitués d’œuvres musicales et de la prestation de telles œuvres sur les ondes de la radio en direct. Redevances 2. La SRC verse à la SCGDV 80 000 $ par mois, payable le premier jour de chaque mois. Intérêts sur paiements tardifs 3. Toute somme non payée à son échéance porte intérêt à compter de la date à laquelle elle aurait dû être acquittée jusqu’à la date où elle est reçue. 4. L’intérêt est calculé quotidiennement, à un taux de un pour cent au-dessus du taux officiel d’escompte de la Banque du Ca- nada en vigueur le dernier jour du mois précédent (tel qu’il est publié par la Banque du Canada). L’intérêt n’est pas composé. Expédition des avis et des paiements 5. (1) Un avis peut être livré par messager, par courrier affran- chi ou par télécopieur. (2) L’avis ou le paiement posté au Canada est présumé avoir été reçu trois jours ouvrables après la date de mise à la poste. (3) L’avis envoyé par télécopieur est présumé avoir été reçu le jour où il est transmis. Renseignements sur l’utilisation de la musique 6. La SRC fournit à la SCGDV, à l’égard de son utilisation de musique, les renseignements qu’elle fournit à la Société cana- dienne des auteurs, compositeurs et éditeurs de musique.
