Copyright Board has certified and hereby publishes the statement
of royalties to be collected by the Neighbouring Rights Collective
of Canada (NRCC) for the performance in public or the com-
munication to the public by telecommunication, in Canada, of
published sound recordings of musical works pursuant to Tariff
No. 3 (Use and Supply of Background Music) for the years 2003
to 2009.

TELECOMMUNICATION, IN CANADA, OF
PUBLISHED SOUND RECORDINGS OF MUSICAL
WORKS FOR THE YEARS 2003 TO 2009
GENERAL PROVISIONS
All royalties payable under this tariff are exclusive of any fed-
eral, provincial or other governmental taxes or levies of any kind.
Tariff No. 3
USE AND SUPPLY OF BACKGROUND MUSIC
Short Title
1. This tariff may be cited as the NRCC Background Music
Tariff, 2003-2009.
Definitions
2. In this tariff,
“establishment” means a place to which the public has access, and
includes a workplace, park, club or school, as well as a means
of public transportation (établissement).
“year” means a calendar year (année).
Application
3. (1) This tariff sets the royalties to be paid to NRCC, for the
benefit of performers and makers, for the performance in public
or the communication to the public by telecommunication of pub-
lished sound recordings of musical works for use as background
music in an establishment, including any use of music with a
telephone on hold.
(2) This tariff does not apply to the use of music as live enter-
tainment, at a live event, or to accompany fitness activities, danc-
ing, dance instruction, skating or other similar activity.
(3) This tariff does not apply to a performance in public or a
communication to the public by telecommunication that is subject
to another NRCC tariff, including the SOCAN-NRCC Pay Audio
Services Tariff.
(4) This tariff is subject to the exception set out in subsec-
tion 69(2) of the Copyright Act.
Royalties Payable When Music is Provided by a Background
Music Supplier
4. When music is provided by a background music supplier, the
royalty payable for the relevant quarter is 3.2 per cent of the
amount paid to subscribe to the background music service, net of
any amount paid by the subscriber for the equipment provided to
him.
Royalties Payable in Other Cases
5. (1) When music is not provided by a background music sup-
plier, the royalty payable for the relevant year shall be calculated
as follows:
(a) if the number of admissions, attendees, or tickets sold for
days or events during which background music was played can
be estimated with reasonable certainty, that number multiplied
by
(i) 0.08¢ in 2003 to 2005, and

UTILISATION ET DISTRIBUTION DE MUSIQUE DE FOND
Titre abrégé

Application
3.
(1)
Le
présent
tarif
établit
les
redevances
payables
à
la
SCGDV, au profit des artistes-interprètes et des producteurs, pour
l’exécution en public ou la communication au public par télé-
communication d’enregistrements sonores publiés d’œuvres mu-
sicales utilisés à titre de musique de fond, y compris l’utilisation
de musique en attente téléphonique.
(2) Le présent tarif ne s’applique pas à l’utilisation de musique
durant un spectacle ou un événement en direct ou pour accompa-
gner les activités de mise en forme, la danse, l’enseignement de la
danse, le patinage ou une autre activité du même genre.
(3) Le présent tarif ne s’applique pas à l’exécution en public ou
à la communication au public par télécommunication assujettie à
un autre tarif de la SCGDV, y compris le Tarif SOCAN-SCGDV
pour les services sonores payants.
(4) Le présent tarif est assujetti à l’exception prévue au para-
graphe 69(2) de la Loi sur le droit d’auteur.
Redevances payables lorsque la musique est acquise d’un
fournisseur de musique de fond
4. Lorsque la musique est acquise d’un fournisseur de musique
de
fond,
la
redevance
payable
pour
le
trimestre
pertinent
est
3,2 pour cent du montant payé pour s’abonner au service de mu-
sique
de
fond,
net
de
tout
montant
payé
par
l’abonné
pour
l’équipement qu’on lui a fourni.
Redevances payables dans les autres cas
5. (1) Lorsque la musique n’est pas acquise d’un fournisseur de
musique de fond, la redevance payable pour l’année pertinente est
établie comme suit :
a) si le nombre d’admissions, de personnes présentes ou de bil-
lets vendus pour une journée ou un événement durant lequel on
a joué de la musique de fond peut être vérifié avec une certi-
tude raisonnable, ce nombre, multiplié par :
(i) 0,08 ¢ de 2003 à 2005,

(ii) 0.0831¢ in 2006, and subject to section 6, thereafter;
(b) if paragraph (a) does not apply, and the capacity of the es-
tablishment
can
be
verified,
that
number
multiplied
by
the
number of days of operation during which background music
was played, multiplied by
(i) 0.15¢ in 2003 to 2005, and
(ii) 0.1558¢ in 2006, and subject to section 6, thereafter;
(c)
if
neither
paragraph
(a)
nor
(b)
applies,
the
number
of
square metres (square feet) of the area to which the public has
access multiplied by the number of days of operation during
which background music was played, multiplied by
(i) 0.25¢ (0.023¢) in 2003 to 2005, and
(ii) 0.2597¢ (0.0239¢) in 2006, and subject to section 6,
thereafter;
(d) in all other instances, including when background music is
only used with telephone on hold,
(i) $26.88 in 2003 to 2005, and
(ii) $27.92 in 2006, and subject to section 6, thereafter.
(2) Notwithstanding subsection (1), as soon as the royalties
payable for a year exceed $350, payments for the rest of that year
and for the following year shall be made on a quarterly basis.
Rate Adjustments to Account for Inflation
6. (1) Subject to subsections (2) to (4), the amount payable in
2007 and thereafter pursuant to section 5 may be increased by a
factor equal to the average annual variation in percentage of the
Consumer Price Index calculated over a 12-month period ending
in September of each year preceding the year in which the in-
crease is applied, minus one percentage point.
(2) An increase can be applied only if the factor is higher than
three percentage points.
(3) An increase can be applied only in January.
(4) An increase that cannot be applied in accordance to subsec-
tion (2) shall be cumulated with the increase for the following
year, and so on.
(5) When NRCC applies an increase, it shall send to the Copy-
right Board and to every person known to NRCC that is subject
to
this
tariff,
before
the
end
of
January,
a
notice
stating
the
following:
“NRCC Tariff 3 (Background music), as certified by the Copy-
right Board of Canada, allows NRCC to increase the rates set
out in section 5 of the tariff to account for inflation, according
to a formula set out in section 6 of the tariff.
Effective January 1, [year in which the increase is applied], the
rates are being increased by [rate of increase] per cent. As a re-
sult, the applicable rates for [year in which the increase is ap-
plied] and thereafter shall be as follows:
(a) if royalties are calculated according to paragraph 5(1)(a)
of
the
tariff,
(admissions,
attendees
or
number
of
tickets
sold), [new applicable rate]¢;
(b) if royalties are calculated according to paragraph 5(1)(b)
of the tariff, (capacity of the establishment), [new applicable
rate]¢;
(c) if royalties are calculated according to paragraph 5(1)(c)
of the tariff (area), [new applicable rate for area measured
in metres]¢ if calculated in metres, and [new applicable rate
for area measured in feet]¢ if calculated in feet; and

(ii) 0,0831

(i) 0,25 ¢ (0,023 ¢) de 2003 à 2005,
(ii) 0,2597
¢ (0,0239 ¢) en 2006 et, sous réserve de l’arti-
cle 6, par la suite;
d) dans tous les autres cas, y compris lorsque la musique de
fond est utilisée uniquement en attente téléphonique :
(i) 26,88 $ de 2003 à 2005,
(ii) 27,92
$ en 2006 et, sous réserve de l’article 6, par la
suite.
(2) Malgré le paragraphe (1), dès que les redevances payables
pour une année dépassent 350 $, les versements pour le reste de
l’année et pour l’année suivante s’effectuent à chaque trimestre.
Rajustement des redevances au titre de l’inflation
6. (1) Sous réserve des paragraphes (2) à (4), le montant paya-
ble en 2007 et par la suite en vertu de l’article 5 peut être aug-
menté par un facteur égal à la variation annuelle moyenne en
pourcentage de l’indice des prix à la consommation calculée pour
une période de douze mois se terminant en septembre de chaque
année
précédant
l’année
à
laquelle
l’augmentation
s’applique,
moins un point de pourcentage.
(2) L’augmentation ne peut être appliquée que si le facteur dé-
passe trois points de pourcentage.
(3) L’augmentation ne peut être appliquée qu’en janvier.
(4) L’augmentation qui ne peut être appliquée à cause du para-
graphe (2) est cumulée avec l’augmentation de l’année suivante,
et ainsi de suite.
(5) Lorsque la SCGDV applique une augmentation, elle fait
parvenir à la Commission du droit d’auteur et à chaque personne
que la SCGDV sait être assujettie au présent tarif, avant la fin
janvier, un avis énonçant ce qui suit :
« Le tarif 3 de la SCGDV (musique de fond), tel qu’homologué
par la Commission du droit d’auteur du Canada, permet à la
SCGDV d’augmenter les taux établis à l’article 5 du tarif pour
tenir compte de l’inflation, conformément à une formule établie
à l’article 6 du tarif.
À partir du 1
er
janvier [année à laquelle l’augmentation s’appli-
que], les taux sont augmentés de [taux de l’augmentation] pour
cent. Par conséquent, les taux applicables en [année à laquelle
l’augmentation s’applique] et par la suite sont les suivants :
a) si les redevances sont calculées conformément à l’ali-
néa

tarif,

b) si les redevances sont calculées conformément à l’ali-

(d) if royalties are payable pursuant to paragraph 5(1)(d) of
the tariff (all other instances), the annual royalty payable
is $[new applicable rate].

(6)
Before
sending
any
notice
pursuant
to
subsection
(5),
NRCC shall post on its Web site a page that provides the detailed
calculation of the increase being applied. That page shall be ac-
cessible to the public directly from the home page of NRCC’s
Web site.
Reporting Requirements
7. (1) No later than 60 days after the end of the year, a person
making a payment pursuant to subsection 5(1) shall pay the roy-
alty for that year and, where applicable, shall report the informa-
tion used to calculate the royalty.
(2) No later than 60 days after the end of the quarter, a person
making a payment pursuant to section 4 or subsection 5(2) shall
pay the royalty for that quarter and, where applicable, shall report
the information used to calculate the royalty.
Accounts and Records
8. (1) A person subject to this tariff shall keep and preserve, for
a period of six years after the end of the year to which they relate,
records from which that person’s payment can be readily ascer-
tained,
including
information
used
to
determine
the
choice
of
calculation and information required to ascertain days on which
background music was used.
(2) NRCC may audit these records at any time during the per-
iod set out in subsection (1) on reasonable notice and during nor-
mal business hours.
(3) NRCC shall, upon receipt, supply a copy of the report of
the audit to the person who was the subject of the audit.
(4) If an audit discloses that royalties due to NRCC have been
understated during any period by more than ten per cent the per-
son who was the subject of the audit shall pay the reasonable
costs of the audit within 30 days of the demand for such payment.
Confidentiality
9. (1) Subject to subsections (2) and (3), NRCC and its agents
shall treat in confidence information received pursuant to this
tariff, unless the person who supplied the information consents in
writing to the information being treated otherwise.
(2) NRCC and its agents may share information referred to in
subsection (1)
(i) with the Copyright Board;
(ii) in connection with proceedings before the Copyright Board,
if NRCC has first provided a reasonable opportunity for the
person providing the information to request a confidentiality
order;
(iii) to the extent required to effect the distribution of royalties,
with its royalty claimants; or
(iv) if required by law or ordered by a court of law.
(3) Subsection (1) does not apply to information that is publicly
available, or to information obtained from someone other than a
person subject to this tariff and who is not under an apparent duty
of confidentiality to that person.

Exigences de rapport
7. (1) Au plus tard 60 jours après la fin de l’année, la personne

graphe 5(2) paie la redevance pour ce trimestre et, le cas échéant,
fournit
les
renseignements
qu’elle
a
utilisés
pour
calculer
la
redevance.
Registres et vérifications
8. (1) La personne assujettie au présent tarif tient et conserve
durant six années après la fin de l’année à laquelle ils se rappor-
tent, les registres permettant de déterminer ses paiements, y com-
pris les renseignements utilisés pour choisir le mode de calcul de
la redevance et ceux permettant d’établir les jours durant lesquels
on a utilisé de la musique de fond.
(2) La SCGDV peut vérifier ces registres à tout moment durant
la période visée au paragraphe (1), durant les heures régulières de
bureau et moyennant un préavis raisonnable.
(3) Sur réception, la SCGDV fournit copie du rapport de vérifi-
cation à la personne qui en a fait l’objet.
(4) Si la vérification révèle que les redevances ont été sous-
estimées de plus de dix pour cent pour une période quelconque, la
personne ayant fait l’objet de la vérification assume les coûts rai-
sonnables de la vérification dans les 30 jours suivant la date à
laquelle on lui en fait la demande.
Traitement confidentiel
9. (1) Sous réserve des paragraphes (2) et (3), la SCGDV et ses
mandataires
gardent
confidentiels
les
renseignements
transmis
en application du présent tarif, à moins que la personne ayant
fourni les renseignements ne consente par écrit à ce qu’ils soient
divulgués.
(2) La SCGDV et ses mandataires peuvent faire part des ren-
seignements visés au paragraphe (1)
(i) à la Commission du droit d’auteur;
(ii) dans le cadre d’une affaire portée devant la Commission, si
la
SCGDV
donne
préalablement
à
l’intéressé
l’occasion
de
demander une ordonnance de confidentialité;
(iii) à une personne qui demande le versement de redevances,
dans la mesure où cela est nécessaire pour effectuer la distribu-
tion;
(iv) si la loi ou une ordonnance d’un tribunal l’y oblige.
(3) Le paragraphe (1) ne s’applique pas aux renseignements
disponibles au public ou obtenus d’un tiers non tenu lui-même de
garder confidentiels ces renseignements.

Adjustments
10. Adjustments in the amount of royalties owed (including ex-
cess payments), as a result of the discovery of an error or other-
wise, shall be made on the date the next royalty payment is due.
Interest on Late Payments
11. Any amount not received by the due date shall bear interest
from that date until the date the amount is received. Interest shall
be calculated daily at a rate equal to one per cent above the Bank
Rate, effective on the last day of the previous month (as published
by the Bank of Canada). Interest shall not compound.
Adresses for Notices, etc.
12. (1) Anything addressed to NRCC shall be sent to 1235 Bay
Street, Suite 910, Toronto, Ontario M5R 3K4, email: background@
nrdv.ca, fax number 416-962-7797 or to any other address, email
address or fax number of which the sender has been notified in
writing.
(2) Anything addressed to a person subject to this tariff shall be
sent to the last address, email address or fax number provided by
that person to NRCC in writing.
Delivery of Notices and Payments
13. (1) A payment must be delivered by hand or by postage
paid mail. Anything else may be delivered by hand, by postage
paid mail, by fax or by email.
(2) A document mailed in Canada shall be presumed to have
been received three business days after the day it was mailed.
(3) A document sent by fax or email shall be presumed to have
been received the day it was transmitted.
Transitional Provisions
14. (1) Any amount that would otherwise be payable on or be-
fore December 1, 2006, pursuant to this tariff, shall be due on
January 15, 2007, and shall be increased by using the multiplying
factor (based on the Bank Rate) set out in the following tables
with respect to that period.

(2) A person making a payment pursuant to subsection (1) shall
also report the information used to calculate the royalty.

Ajustement

Intérêts sur paiements tardifs
11.
Tout
montant
non
payé
à
son
échéance
porte
intérêt
à
compter de la date à laquelle il aurait dû être acquitté jusqu’à la
date où il est reçu. L’intérêt est calculé quotidiennement, à un
taux de un pour cent au-dessus du taux officiel d’escompte en
vigueur le dernier jour du mois précédent (tel qu’il est publié par
la Banque du Canada). L’intérêt n’est pas composé.

13. (1) Un paiement est livré en mains propres ou par courrier
affranchi. Toute autre communication peut être livrée en mains
propres, par courrier affranchi, par courriel ou par télécopieur.
(2) Un document posté au Canada est présumé avoir été reçu
trois jours ouvrables après la date de mise à la poste.
(3) Un document envoyé par télécopieur ou par courriel est
présumé avoir été reçu le jour où il est transmis.
Dispositions transitoires
14. (1) Les redevances par ailleurs exigibles au plus tard le

décembre 2006 en vertu du présent tarif sont payables au plus
tard le 15 janvier 2007 et sont majorées en utilisant le facteur de
