2018-07-07 Supplement to the Canada Gazette STATEMENT OF ROYALTIES TO BE COLLECTED BY RE:SOUND FOR THE COMMUNICATION TO THE PUBLIC BY TELECOMMUNICATION, IN CANADA, OF PUBLISHED SOUND RECORDINGS EMBODYING MUSICAL WORKS AND PERFORMERS’ PERFORMANCES OF SUCH WORKS FOR THE YEARS 1998 TO 2021 Tariff No. 1 RADIO B. Non-Commercial Radio Other than the Canadian Broadcasting Corporation Short Title 1. This tariff may be cited as the Re:Sound Non-Commercial Radio Tariff, 1998-2021. Definitions 2. In this tariff, “non-commercial radio station” means any radio station that transmits in analog or digital mode, whether in the A.M. or F.M. frequency band or in any other range assigned by the Minister under section 5 of the Radiocom- munication Act other than a Canadian Broadcasting Cor- poration radio station, that is owned and operated by a not-for-profit organization, including any campus station, community station, native station, or ethnic station owned and operated by a not-for-profit organization, whether or not any part of the station’s gross operating costs is funded by advertising revenues, and whether or not the station is licensed by the Canadian Radio-television and Telecom- munications Commission; (« station de radio non commerciale ») “year” means a calendar year. (« année ») Application 3. (1) This tariff sets the royalties to be paid to Re:Sound by non-commercial radio stations for the communication to the public by telecommunication, in Canada, of pub- lished sound recordings embodying musical works and performers’ performances of such works, by over-the-air radio broadcasting, for the years 1998 to 2021. (2) This tariff does not apply to a communication to the public by telecommunication of sound recordings to end- users via the Internet or another digital network, to a device including computers, digital media players, cellular phones, smartphones and tablets. Aux fins du présent tarif, les termes suivants se défi- nissent comme suit : « année » signifie une année civile; (“year”) « station de radio non commerciale » signifie toute station de radio qui transmet un signal en mode analogue ou numérique, dans la bande de fréquences MA ou MF ou toute autre gamme de fréquences attribuée par le ministre aux termes de l’article 5 de la Loi sur la radiocommunica- tion, à l’exception d’une station de radio de la Société Radio-Canada, à titre de station exploitée par une per- sonne morale sans but lucratif, incluant toute station de radio de campus, station de radio communautaire ou autochtone exploitée à des fins non lucratives, que ses coûts bruts d’exploitation soient financés ou non par des recettes publicitaires et que cette station détienne ou non une licence du Conseil de la radiodiffusion et des télé- communications canadiennes. (“non-commercial radio station”) Application 3. (1) Le présent tarif établit les redevances payables à Ré:Sonne par les stations de radio non commerciales pour la communication au public par télécommunication, au Canada, d’enregistrements sonores publiés constitués d’œuvres musicales et de prestations de telles œuvres par voie de radiodiffusion par ondes hertziennes pour les années 1998 à 2021. (2) Le présent tarif ne s’applique pas à une communica- tion au public par télécommunication d’enregistrements sonores à des usagers par Internet ou par un autre réseau numérique, vers un appareil comme un ordinateur, un lecteur de contenu numérique, un téléphone cellulaire, un téléphone intelligent et une tablette numérique. (3) This tariff does not apply to a communication to the public by telecommunication that is subject to another Re:Sound tariff, including Re:Sound Tariffs 1.A, 1.C and 8. Royalties 4. (1) The royalties payable to Re:Sound by a non- commercial radio station in respect of each year shall be $100. (2) All royalties payable under this tariff are exclusive of any applicable federal, provincial or other governmental taxes or levies of any kind. Payments and Reporting 5. No later than January 1 of each year, a non-commercial radio station shall pay the fee owing for that year. Interest on Late Payments 6. Any amount not received by the due date shall bear interest from that date until the date the amount is received. Interest shall be calculated daily, at a rate equal to one per cent above the Bank Rate effective on the last day of the previous month (as published by the Bank of Canada). Interest shall not compound. Delivery of Notices and Payments 7. (1) Anything addressed to Re:Sound shall be sent to 1235 Bay Street, Suite 900, Toronto, Ontario M5R 3K4, fax number: 416-962-7797, email: radio@resound.ca, or to any other address, email address or fax number of which the non-commercial radio station has been notified in writing. (2) Anything addressed to a non-commercial radio station shall be sent to the last address, email address or fax num- ber of which Re:Sound has been notified in writing. (3) A notice may be delivered by hand, by postage-paid mail, by email, by fax, or by file transfer protocol (FTP). A payment may be delivered by hand, by postage-paid mail or by electronic bank transfer (EBT). Where a payment is delivered by EBT, the associated reporting shall be pro- vided concurrently to Re:Sound by email. Redevances 4. (1) Les redevances payables chaque année à Ré:Sonne par une station de radio non commerciale seront de 100 $. (2) Les redevances payables aux termes du présent tarif ne comprennent ni les taxes fédérales, provinciales ou autres applicables, ni les prélèvements d’autre genre qui pour- raient s’appliquer. Paiements et rapport 5. Au plus tard le 1 er janvier de chaque année, la station de radio non commerciale verse la redevance qu’elle doit payer pour l’année en cause. Intérêts sur paiements en retard 6. Le montant qui n’est pas reçu au plus tard à la date d’échéance portera intérêt à compter de cette date jusqu’à la date à laquelle le montant est reçu. L’intérêt est calculé quotidiennement, à un taux de un pour cent au-dessus du taux officiel d’escompte de la Banque du Canada en vigueur le dernier jour du mois précédent (tel qu’il est publié par la Banque du Canada). L’intérêt n’est pas composé. Expédition des avis et des paiements 7. (1) Toute communication avec Ré:Sonne est adressée au 1235, rue Bay, Bureau 900, Toronto (Ontario) M5R 3K4, numéro de télécopieur : 416-962-7797, courriel : radio@ resonne.ca, ou à toute autre adresse ou adresse de courriel ou tout autre numéro de télécopieur dont la station a été avisée par écrit. (2) Toute communication avec une station de radio non commerciale est adressée à la dernière adresse ou adresse de courriel ou au dernier numéro de télécopieur dont Ré:Sonne a été avisée par écrit. (3) Un avis peut être livré par messager, par courrier affranchi, par courriel, par télécopieur ou au moyen du protocole FTP. Un paiement peut être livré par messager, par courrier affranchi ou par virement électronique de fonds (EBT). Si un paiement est effectué par EBT, le rap- port y afférent doit être transmis simultanément à Ré:Sonne par courriel.
