As used in this tariff, the terms “licence,” “licence to per- form” and “licence to communicate to the public by tele- communication” mean a licence to perform in public or to communicate to the public by telecommunication or to authorize the performance in public or the communica- tion to the public by telecommunication, including the right to make works available to the public by telecom- munication in a way that allows a member of the public to have access to them from a place and at a time individ- ually chosen by that member of the public. Except where otherwise specified, fees payable for any licence granted by SOCAN shall be due and payable upon grant of the licence. Interest shall be calculated daily, at a rate equal to one per cent above the Bank Rate effective on the last day of the previous month (as published by the Bank of Canada). Interest shall not compound. Each licence shall subsist according to the terms set out therein. SOCAN shall have the right at any time to termin- ate a licence for breach of terms or conditions upon 30 days’ notice in writing. Tariff Tariff of royalties to be collected by the Society of Com- posers, Authors and Music Publishers of Canada (SOCAN) in compensation for the right to perform in public or to communicate to the public by telecommunication, in Canada, musical or dramatico-musical works forming part of its repertoire including the right to make such works available to the public by telecommunication in a way that allows a member of the public to have access to them from a place and at a time individually chosen by that member of the public. For a licence to perform, at any time and as often as desired in the years 2018, 2019, 2020, 2021 and 2022, any or all of the works in SOCAN’s repertoire by (a) a station operated by the Société de télédiffusion du Québec (STQ); and (b) the websites and other technological platforms (e.g. Internet, iPod, mobile phones, iPad) operated by the STQ, i.e. uses that would otherwise be the subject of SOCAN Tariff 22.E, the annual fee is $216,000 payable in equal quarterly instalments on March 31, June 30, September 30 and December 15 of the year covered by the licence. Tariff 2.C does not apply to the use of music covered under SOCAN Tariff 17 (Pay, Specialty and Other Television Services). Tarif Tarif des redevances que la Société canadienne des auteurs, compositeurs et éditeurs de musique (SOCAN) peut per- cevoir en compensation pour l’exécution en public, ou la communication au public par télécommunication, au Canada, d’œuvres musicales ou dramatico-musicales fai­ sant partie de son répertoire, y compris le fait de mettre à la disposition du public par télécommunication une œuvre de manière à ce que chacun puisse y avoir accès de l’endroit et au moment qu’il choisit individuellement. Pour une licence permettant l’exécution en tout temps et aussi souvent que désiré en 2018, 2019, 2020, 2021 et 2022, de l’une ou de la totalité des œuvres faisant partie du répertoire de la SOCAN sur : a) les ondes d’une station exploitée par la Société de télédiffusion du Québec (STQ); b) les sites Web et autres plateformes technologiques (par exemple Internet, iPod, téléphone mobile, iPad) exploités par la STQ, c’est-à-dire les utilisations qui seraient autrement couvertes par le Tarif 22.E de la SOCAN, la redevance annuelle est de 216 000 $, payable en versements trimestriels égaux le 31 mars, le 30 juin, le 30 septembre et le 15 décembre de l’année visée par la licence. Le Tarif 2.C ne s’applique pas aux usages couverts par le Tarif 17 de la SOCAN (Services de télévision payante, ser- vices spécialisés et autres services de télévision).
