As used in this tariff, the terms “licence,” “licence to per- form” and “licence to communicate to the public by tele- communication” mean a licence to perform in public or to communicate to the public by telecommunication or to authorize the performance in public or the communica- tion to the public by telecommunication, including the right to make works available to the public by telecom- munication in a way that allows a member of the public to have access to them from a place and at a time individ- ually chosen by that member of the public. Except where otherwise specified, fees payable for any licence granted by SOCAN shall be due and payable upon grant of the licence. Interest shall be calculated daily, at a rate equal to one per cent above the Bank Rate effective on the last day of the previous month (as published by the Bank of Canada). Interest shall not compound. Each licence shall subsist according to the terms set out therein. SOCAN shall have the right at any time to termin- ate a licence for breach of terms or conditions upon 30 days’ notice in writing. Tariff Tariff of royalties to be collected by the Society of Com- posers, Authors and Music Publishers of Canada (SOCAN) in compensation for the right to perform in public or to communicate to the public by telecommunication, in Can- ada, musical or dramatico-musical works forming part of its repertoire, including the right to make such works available to the public by telecommunication in a way that allows a member of the public to have access to them from a place and at a time individually chosen by that member of the public. For a licence to perform, by means of recorded music, at any time and as often as desired in the years 2018 to 2022, any or all of the works in SOCAN’s repertoire, in an adult entertainment club, the fee payable by the establishment is 4.7¢ per day, multiplied by the capacity (seating and standing) authorized under the establishment’s liquor licence or any other document issued by a competent authority for this type of establishment. “Day” means any period between 6:00 a.m. on one day and 6:00 a.m. the following day during which the establish- ment operates as an adult entertainment club. No later than January 31 of the year covered by the licence, the licensee shall file a report estimating the amount of royalties and send to SOCAN the report and the estimated fee. No later than January 31 of the following year, the licensee shall file with SOCAN a report indicating the authorized capacity (seating and standing) of the establishment, as well as the number of days it operated as an adult enter- tainment club during the previous year, and an adjust- ment of the licence fee shall be made accordingly. Any additional monies owed shall then be paid to SOCAN; if the fee due is less than the amount paid, SOCAN shall credit the licensee with the amount of the overpayment. SOCAN shall have the right to audit the licensee’s books and records, on reasonable notice and during normal business hours, to verify the statements rendered and the fee payable by the licensee. Tarif Tarif des redevances que la Société canadienne des auteurs, compositeurs et éditeurs de musique (SOCAN) peut percevoir en compensation pour l’exécution en public, ou la communication au public par télécommuni­ cation, au Canada, d’œuvres musicales ou dramatico­ musicales faisant partie de son répertoire, y compris le fait de mettre à la disposition du public par télécommunica­ tion une œuvre de manière que chacun puisse y avoir accès de l’endroit et au moment qu’il choisit individuellement. Pour une licence permettant l’exécution, au moyen de musique enregistrée, en tout temps et aussi souvent que désiré pendant les années 2018 à 2022, de l’une ou de la totalité des œuvres faisant partie du répertoire de la SOCAN, dans un club de divertissement pour adultes, la redevance exigible est de 4,7 ¢ par jour, multiplié par le nombre de places (debout et assises) autorisées selon le permis d’alcool ou tout autre document délivré par les autorités compétentes pour ce genre d’établissement. « Jour » s’entend d’une période débutant à 6 h du matin une journée et se terminant à 6 h du matin le lendemain, durant laquelle l’établissement est exploité à titre de club de divertissement pour adultes. Au plus tard le 31 janvier de l’année visée par la licence, le titulaire de la licence soumet à la SOCAN un rapport esti­ mant le montant de la redevance exigible et fait parvenir avec ce rapport la redevance correspondante. Au plus tard le 31 janvier de l’année suivante, le titulaire de la licence soumet à la SOCAN un rapport indiquant le nombre de places (debout et assises) autorisées de l’éta­ blissement ainsi que le nombre de jours de l’année précé­ dente durant lesquels il a été exploité à titre de club de divertissement pour adultes, et le coût de la licence est ajusté en conséquence. Le paiement de toute somme due accompagne le rapport; si le coût de la licence est inférieur au montant déjà payé, la SOCAN porte le supplément au crédit du titulaire de la licence. La SOCAN peut vérifier les livres et registres du titulaire de la licence durant les heures normales de bureau, moyennant un préavis raisonnable, afin de confirmer les rapports soumis par le titulaire de la licence et la rede­ vance exigible de ce dernier.

2020-08-08 Supplement to the Canada Gazette The licensee may request that the examination be made by an independent auditor chosen by the licensee from a list of at least three auditors furnished by SOCAN. In such a case, only the auditor so appointed need be allowed access to the licensee’s records. If the audit discloses that the licence fee owed to SOCAN has been understated by more than 10 per cent, the licensee shall pay the auditor’s fees. Dans ce cas, le titulaire n’est tenu de donner accès à ses registres qu’au vérificateur ainsi choisi. Si la vérification révèle que la redevance à verser a été sous-estimée de plus de 10 pour cent, le titulaire de la licence défraie les hono­ raires du vérificateur.
