4 Supplement to the Canada Gazette STATEMENT OF ROYALTIES TO BE COLLECTED BY THE SOCIETY OF COMPOSERS, AUTHORS AND MUSIC PUBLISHERS OF CANADA (SOCAN) FOR THE COMMUNICATION TO THE PUBLIC BY TELECOMMUNICATION, IN CANADA, OF MUSICAL OR DRAMATICO-MUSICAL WORKS FOR THE YEARS 2003 TO 2005 Note: The reader will notice that the tariff contains a reference to the year 2006 even though the tariff itself expires at the end of 2005. That can be explained by the fact that the tariff was certi- fied after the date it was due to expire. Transitional provisions were required to ensure that users have a reasonable amount of time after the tariff is certified to fulfil their obligations pursuant to the tariff. Furthermore, through the application of subsec- tion 68.2(3) of the Copyright Act, the tariff, though it expires on December 31, 2005, continues to apply on an interim basis until the Board certifies a further tariff for the period starting Janu- ary 1, 2006. GENERAL PROVISIONS All royalties payable under this tariff are exclusive of any fed- eral, provincial or other governmental taxes or levies of any kind. As used in this tariff, the terms “licence” and “licence to com- municate to the public by telecommunication” mean a licence to communicate to the public by telecommunication or to authorize the communication to the public by telecommunication, as the context may require. Every SOCAN licence shall subsist according to the terms set out therein. SOCAN shall have the right at any time to terminate a licence for breach of terms or conditions upon 30 days notice in writing. Tariff No. 24 RINGTONES For a licence to communicate to the public by telecommunica- tion, at any time and as often as desired in 2003 to 2005, a ring- tone for which a SOCAN licence is required, the royalty payable is 6 per cent of the price paid by the subscriber for the ringtone, net of any network usage fees, subject to a minimum royalty of 6¢ each time a ringtone is supplied in 2004 or 2005. Notwithstanding the previous paragraph, the royalty payable for any quarter in 2003 shall not exceed $7,500 per licensee. “ringtone” means a digital audio file that is played to indicate an incoming telephone call. Royalties shall be due no later than 60 days after the end of each quarter. The payment shall be accompanied by a report showing, with respect to the relevant quarter, (a) the total number of ringtones supplied; (b) the total number of ringtones requiring a SOCAN licence supplied and the total amount payable by subscribers for those ringtones; (c) with respect to each ringtone requiring a SOCAN licence, August 19, 2006 TARIF DES REDEVANCES À PERCEVOIR PAR LA SOCIÉTÉ CANADIENNE DES AUTEURS, COMPOSITEURS ET ÉDITEURS DE MUSIQUE (SOCAN) POUR LA COMMUNICATION AU PUBLIC PAR TÉLÉCOMMUNICATION, AU CANADA, D’ŒUVRES MUSICALES OU DRAMATICO-MUSICALES POUR LES ANNÉES 2003 À 2005 Note : La lecture du tarif révèle qu’il contient une référence à l’année 2006 malgré le fait qu’il cesse d’avoir effet à la fin de 2005. Cela s’explique du fait que le tarif a été homologué après la date à laquelle il prend fin. Des dispositions transitoires étaient nécessaires pour garantir que les utilisateurs disposent de suffi- samment de temps après l’homologation du tarif pour remplir les obligations qu’il leur impose. Par ailleurs, par l’effet du paragra- phe 68.2(3) de la Loi sur le droit d’auteur, le tarif, bien qu’il prenne fin le 31 décembre 2005, continue de s’appliquer à titre provisoire jusqu’à ce que la Commission homologue un nouveau tarif s’appliquant à partir du 1 er janvier 2006. DISPOSITIONS GÉNÉRALES Les redevances exigibles en vertu du présent tarif ne compren- nent ni les taxes fédérales, provinciales ou autres, ni les autres prélèvements qui pourraient s’appliquer. Dans le présent tarif, « licence » et « licence permettant la com munication au public par télécommunication » signifient, selon le contexte, une licence de communication au public par télécom- munication ou une licence permettant d’autoriser une tierce partie à communiquer au public par télécommunication. Chaque licence de la SOCAN reste valable en fonction des conditions qui y sont énoncées. La SOCAN peut, en tout temps, mettre fin à toute licence sur préavis écrit de 30 jours pour viola- tion des modalités de la licence. Tarif n o 24 SONNERIES Pour une licence permettant la communication au public par té- lécommunication, en tout temps et aussi souvent que désiré en 2003, 2004 ou 2005, d’une sonnerie nécessitant une licence de la SOCAN, la redevance est de 6 pour cent du prix payé par l’abon- né pour la sonnerie, net des frais d’utilisation de réseau, sous ré- serve d’une redevance minimale de 6 ¢ chaque fois qu’une sonne- rie est fournie en 2004 ou 2005. Malgré le paragraphe précédent, la redevance payable à l’égard d’un trimestre donné en 2003 est plafonnée à 7 500 $ par titulaire de licence. « sonnerie » s’entend d’un fichier numérique audio dont l’exé- cution signale un appel entrant. La redevance est payable au plus tard 60 jours après la fin de chaque trimestre. Le paiement est accompagné d’un rapport indi- quant, à l’égard du trimestre pertinent : a) le nombre total de sonneries fournies; b) le nombre total de sonneries fournies nécessitant une licence de la SOCAN et le montant total payable par les abonnés pour ces sonneries; c) à l’égard de chaque sonnerie nécessitant une licence de la SOCAN :

Le 19 août 2006 (i) the total number of times the ringtone was supplied at a particular price, and (ii) any other available information—such as the title of the work, the name of the author, the name of the performer, the Universal Product Code (UPC) and the International Stan- dard Recording Code (ISRC)—that may help SOCAN determine the owner of copyright in the work used in the ringtone; and (d) with respect to each ringtone not requiring a SOCAN li cence, information that establishes why the licence was not required. Notwithstanding the preceding paragraphs, any amount that would otherwise be payable pursuant to this tariff before June 30, 2006, shall be due no later than 90 days from the publication of this tariff, and shall be increased by using the multiplying factor (based on the Bank Rate) set out in the following table with re spect to each period. Malgré ce qui précède, les redevances par ailleurs exigibles avant le 30 juin 2006 en vertu du présent tarif sont payables au plus tard 90 jours après la publication du présent tarif et sont ma- jorées en utilisant le facteur de multiplication (basé sur le taux d’escompte) établi à l’égard de la période indiquée dans le tableau qui suit.
