In accordance with subsection 68(4) of the Copyright Act, the
Copyright Board has certified and hereby publishes the statement
of royalties to be collected by the Society of Composers, Authors
and Music Publishers of Canada (SOCAN) for the communica-
tion to the public by telecommunication, in Canada, of musical or
dramatico-musical works in respect of commercial radio for the
years 2003 to 2007, and by the Neighbouring Rights Collective of
Canada (NRCC) for the communication to the public by tele-
communication, in Canada, of published sound recordings em-
bodying musical works and performers’ performances of such
works in respect of commercial radio for the years 2003 to 2007.
Note
:
This tariff replaces the tariff that the Board certified on Octo-
ber 15, 2005 and that was set aside by the Federal Court of Ap-
peal on October 19, 2006.

Tarif des redevances à percevoir pour la communication au
public par télécommunication, au Canada, d’œuvres musicales ou
dramatico-musicales, et d’enregistrements sonores publiés
d’œuvres musicales et de prestations de telles œuvres
Conformément au paragraphe 68(4) de la Loi sur le droit d’au-
teur, la Commission du droit d’auteur a homologué et publie le
tarif que la Société canadienne des auteurs, compositeurs et édi-
teurs de musique (SOCAN) peut percevoir pour la communica
tion au public par télécommunication, au Canada, d’œuvres musi-
cales ou dramatico-musicales, à l’égard de la radio commerciale
pour les années 2003 à 2007, et que la Société canadienne de ges-
tion des droits voisins (SCGDV) peut percevoir pour la commu-
nication au public par télécommunication, au Canada, d’enregis-
trements sonores publiés constitués d’œuvres musicales et de la
prestation de telles œuvres à l’égard de la radio commerciale pour
les années 2003 à 2007.
Note :
Le présent tarif remplace celui que la Commission avait homo-
logué le 15 octobre 2005 et que la Cour d’appel fédérale avait
annulé le 19 octobre 2006.

GENERAL PROVISIONS
All royalties payable under this tariff are exclusive of any fed-
eral, provincial or other governmental taxes or levies of any kind.
Every SOCAN licence shall subsist according to the terms set
out therein. SOCAN shall have the right at any time to terminate a
licence for breach of terms or conditions upon 30 days notice in
writing.
Tariff No. 1
RADIO
A. Commercial Radio
Short Title
1. This tariff may be cited as the SOCAN-NRCC Commercial
Radio Tariff, 2003-2007.
Definitions
2. In this tariff,
“Act” means the Copyright Act; (« Loi »)
“advertising revenues” has the meaning ascribed to this expres-
sion
by
the
Regulations

“low-use station” means a station that
(a) broadcasts works in the repertoire of SOCAN for less
than 20 per cent of its total broadcast time (excluding pro-
duction music) during the reference month; and
(b) keeps and makes available to SOCAN and NRCC com-
plete recordings of its last 90 broadcast days; (« station à
faible utilisation »)
“production music” means music used in interstitial programming
such as commercials, public service announcements and jin-
gles; (« musique de production »)
“reference month” means the second month before the month for
which royalties are being paid; (« mois de référence »)
“year” means a calendar year. (« année »)
Application
3. (1) This tariff sets the royalties to be paid each month by
commercial radio stations for the communication to the public by
telecommunication, by over-the-air broadcasting and for private or

Chaque licence de la SOCAN reste valable en fonction des
conditions qui y sont énoncées. La SOCAN peut, en tout temps,
mettre fin à toute licence sur préavis écrit de 30 jours pour viola-
tion des modalités de la licence.

A. Radio commerciale

Définitions
2. Les définitions qui suivent s’appliquent au présent tarif.
« année » Année civile. (“year”)
« Loi » Loi sur le droit d’auteur. (“Act”)
« mois de référence » Mois antérieur au mois qui précède celui

« musique de production » Musique incorporée dans la program-
mation interstitielle, tels les messages publicitaires, les messa-

Application
3. (1) Le présent tarif établit les redevances payables chaque
mois par une station de radio commerciale pour la communication
au public par télécommunication, par radiodiffusion hertzienne

domestic use, of musical and dramatico-musical works in SOCAN’s
repertoire and of published sound recordings embodying musical
works and performers’ performances of such works in NRCC’s
repertoire.
(2) This tariff does not apply to a communication to the public
by telecommunication that is subject to another tariff, including
SOCAN Tariffs 16 or 22 or the SOCAN-NRCC Pay Audio Ser-
vices Tariff.
4. This tariff is subject to the special royalty rates set out in
paragraph 68.1(1)(a) of the Act.
Royalties
5. (1) A low-use station shall pay 1.5 per cent of its advertising
revenues during the reference month to SOCAN and 0.75 per cent
of these revenues to NRCC.
(2) Any other station shall pay, on its advertising revenues dur-
ing the reference month,
(a) to SOCAN, 3.2 per cent on its first $1.25 million of annual
revenues and 4.4 per cent on the rest; and
(b) to NRCC, 1.44 per cent on its first $1.25 million of annual
revenues and 2.1 per cent on the rest.
Reporting Requirements
6. No later than the first day of each month, the station shall
pay the royalties for that month and report the station’s advertis-
ing revenues for the reference month.
Music and Sound Recording Use Information
7.
(1)
Upon
receipt
of
a
written
request
from
SOCAN
or
NRCC, a station shall provide to both collective societies, with
respect to each musical work and to each published sound record-
ing embodying a musical work broadcast by the station during the
days listed in the request:
(a) the date and time of broadcast;
(b) the title of the work, the name of its author and composer;
and
(c) where applicable, the title of the album, the name of the
performers or performing groups and the record label.
(2) The information set out in subsection (1) shall be provided
in electronic format where possible, otherwise in writing, no later
than 14 days after the end of the month to which it relates.
(3) A station is not required to provide the information set out
in subsection (1) with respect to more than 14 days in a year.
Accounts and Records
8. (1) A station shall keep and preserve, for a period of six
months after the end of the month to which they relate, records
from which information requested pursuant to section 7 can be
readily ascertained.
(2) A station shall keep and preserve, for a period of six years
after the end of the year to which they relate, records from which
the station’s advertising revenues can be readily ascertained.
(3) A collective society may audit these records at any time
during the period set out in subsection (1) or (2), as well as the
broadcast day recordings of a low-use station, on reasonable no-
tice and during normal business hours.

ou 22 de la SOCAN ou le tarif SOCAN-SCGDV applicable aux
services sonores payants.
4. Le présent tarif est assujetti au taux spécial prévu à l’ali-
néa 68.1(1)a) de la Loi.
Redevances
5. (1) Une station à faible utilisation verse 1,5 pour cent des re-
cettes publicitaires qu’elle a perçues durant le mois de référence à
la SOCAN et 0,75 pour cent de ces recettes à la SCGDV.
(2) Toute autre station verse, à l’égard des recettes publicitaires
qu’elle a perçues durant le mois de référence,
a)
à
la
SOCAN,
3,2
pour
cent
sur
la
première
tranche
de
1,25 million de dollars de recettes annuelles et 4,4 pour cent sur
l’excédent;
b) à la SCGDV, 1,44 pour cent sur la première tranche de
1,25 million de dollars de recettes annuelles et 2,1 pour cent sur
l’excédent.
Obligations de rapport
6. Au plus tard le premier du mois, la station verse les redevan-
ces payables pour ce mois et fait rapport de ses recettes publicitai-
res pour le mois de référence.
Renseignements sur l’utilisation d’œuvres musicales et
d’enregistrements sonores
7. (1) Sur demande écrite de la SOCAN ou de la SCGDV, la
station fournit aux deux sociétés les renseignements suivants à
l’égard de chaque œuvre musicale et de chaque enregistrement
sonore publié d’œuvre musicale qu’elle a diffusés pendant les
jours indiqués dans la demande :
a) la date et l’heure de diffusion;
b) le titre de l’œuvre, le nom de l’auteur et du compositeur;
c)
le
cas
échéant,
le
titre
de
l’album,
le
nom
des
artistes-
interprètes ou groupes d’interprètes et celui de la maison de
disque.
(2) La station fournit les renseignements visés au paragraphe (1)
au plus tard 14 jours après la fin du mois auquel ils se rapportent,
si possible sous forme électronique et sinon, par écrit.
(3) La station n’est pas tenue de fournir les renseignements vi-
sés au paragraphe (1) à l’égard de plus de 14 jours par année.
Registres et vérifications
8. (1) La station tient et conserve durant six mois après la fin
du mois auquel ils se rapportent les registres permettant de déter-
miner facilement les renseignements demandés conformément à
l’article 7.
(2) La station tient et conserve durant six années après la fin de
l’année à laquelle ils se rapportent les registres permettant de
déterminer facilement ses recettes publicitaires.
(3) Une société de gestion peut vérifier ces registres à tout
moment
durant
la période
visée
au
paragraphe
(1)
ou
(2), de
même que l’enregistrement des journées de radiodiffusion d’une
station à faible utilisation, durant les heures régulières de bureau
et moyennant un préavis raisonnable.

(4) The collective society shall, upon receipt, supply a copy of
the report of the audit to the station which was the object of the
audit and to the other collective society.
(5) If the audit of a station discloses that the royalties due to the
collective society have been understated in any month by more
than ten per cent, the station shall pay the reasonable costs of
audit within 30 days of the demand for such payment.
Confidentiality
9. (1) Subject to subsections (2) and (3), a collective society
shall treat in confidence information received pursuant to this
tariff, unless the station that supplied the information consents in
writing to the information being treated otherwise.
(2) A collective society may share information referred to in
subsection (1)
(a) with the other collective society;
(b) with the Copyright Board;
(c) in connection with proceedings before the Copyright Board,
if the collective society has first provided a reasonable oppor-
tunity for the station that supplied the information to request a
confidentiality order;
(d) to the extent required to effect the distribution of royalties,
with any other collecting body or with its royalty claimants; or
(e) if required by law or by a court of law.
(3) Subsection (1) does not apply to information that is publicly
available, or to information obtained from someone other than the
station and who is not under an apparent duty of confidentiality to
that station.
Adjustments
10. Adjustments in the amount of royalties owed (including ex-
cess payments), as a result of the discovery of an error or other-
wise, shall be made on the date the next royalty payment is due.
Interests on Late Payments
11. Any amount not received by the due date shall bear interest
from that date until the date the amount is received. Interest shall
be calculated daily, at a rate equal to one per cent above the Bank
of Canada Rate effective on the last day of the previous month (as
published by the Bank of Canada). Interest shall not compound.
Addresses for Notices, etc.
12. (1) Anything addressed to SOCAN shall be sent to 41 Val-
leybrook Drive, Toronto, Ontario M3B 2S6, fax number 416-445-
7108, or to any other address or fax number of which the sender
has been notified.
(2) Anything addressed to NRCC shall be sent to 1235 Bay
Street, Suite 910, Toronto, Ontario M5R 3K7, fax number 416-
962-7797, or to any other address or fax number of which the
sender has been notified.
(3) Anything addressed to a station shall be sent to the last ad-
dress or fax number of which the sender has been notified.
Delivery of Notices and Payments
13. (1) A notice may be delivered by hand, by postage paid
mail, by fax or by email.

(4) Dès qu’elle reçoit un rapport de vérification, la société de

Traitement confidentiel
9. (1) Sous réserve des paragraphes (2) et (3), une société de
gestion garde confidentiels les renseignements qui lui sont trans-
mis en application du présent tarif, à moins que la station ayant
fourni les renseignements ne consente par écrit à ce qu’il en soit
autrement.
(2) Une société de gestion peut faire part des renseignements
visés au paragraphe (1)
a) à l’autre société de gestion;
b) à la Commission du droit d’auteur;
c) dans le cadre d’une affaire portée devant la Commission, si
la société de gestion donne préalablement à la station ayant
fourni les renseignements l’occasion de demander une ordon-
nance de confidentialité;
d) à une autre société de gestion ou à une personne qui de-
mande le versement de redevances, dans la mesure où cela est
nécessaire pour effectuer la distribution;
e) si la loi ou une ordonnance d’un tribunal l’y oblige.
(3) Le paragraphe (1) ne s’applique pas aux renseignements
disponibles au public ou obtenus d’un tiers non tenu lui-même de
garder confidentiels ces renseignements.
Ajustements
10. L’ajustement dans le montant des redevances payables (y
compris
le
trop-perçu),
qu’il
résulte
ou
non
de
la
découverte
d’une erreur, s’effectue à la date à laquelle le prochain versement
doit être acquitté.
Intérêts sur paiements tardifs
11.
Tout
montant
non
payé
à
son
échéance
porte
intérêt
à
compter de la date à laquelle il aurait dû être acquitté jusqu’à la
date où il est reçu. L’intérêt est calculé quotidiennement, à un
taux de un pour cent au-dessus du taux officiel d’escompte de la
Banque du Canada en vigueur le dernier jour du mois précédent
(tel qu’il est publié par la Banque du Canada). L’intérêt n’est pas
composé.
Adresses pour les avis, etc.
12. (1) Toute communication avec la SOCAN est expédiée au

Expédition des avis et des paiements
13. (1) Un avis peut être livré par messager, par courrier af-
franchi, par télécopieur ou par courriel.

(2) A notice or payment mailed in Canada shall be presumed
to have been received three business days after the day it was
mailed.
(3) A notice sent by fax or email shall be presumed to have
been received the day it is transmitted.
Transitional Provisions
14. (1) Royalties owed as a result of the increase in the applic-
able rates and that have not already been paid pursuant to sec-
tion 15 of the SOCAN-NRCC Commercial Radio Tariff, 2003-
2007 that the Board had certified on October 15, 2005, shall be
paid in 12 equal instalments, on the first day of each month, start-
ing on April 1, 2008.
(2) Royalties payable pursuant to subsection (1) shall not bear
any interest if they are paid pursuant to subsection (1).

(2) L’avis ou le paiement posté au Canada est présumé avoir

2005, sont payables en 12 versements égaux le premier jour de
chaque mois à compter du 1

avril 2008.
(2) Les redevances visées au paragraphe (1) ne sont pas assu-
jetties au versement d’intérêts si elles sont versées conformément
au paragraphe (1).
