RULING OF THE BOARD
Proceeding: CBRA Commercial Media Monitoring Tariffs
May 3, 2001
[1] CBRA's application for an interim tariff is denied. As this matter deals with a currently uncertified tariff, issuing an interim tariff could be interpreted as setting a policy precedent on a substantive matter not yet properly heard by the Board. The legal issues raised in these proceedings are not sufficiently complex to justify their being examined separately from the substantive issues. Furthermore, a reasonable dispute exists on legal issues such as the existence of rights and retroactivity. In the Board's view, it would be best if those issues, including those regarding quantum and terms and conditions of the tariff, be fully addressed at a hearing.
[2] As CBRA’s application is denied, the Board is prepared to hear this matter at the earliest possible time convenient to the parties.
