ORDER OF THE BOARD

File: Re:Sound Tariff 4 – Satellite Radio Services (2019-2021)

[1] On March 25, 2022, in Order [CB-CDA 2022-017], the Board ordered the parties to provide a copy of all agreements that modify or supplement the text of the “settlement” tariff filed in the above-mentioned proceeding.

[2] The Board is now in receipt of the agreements filed by Re:Sound on April 4, 2022.

[3] We note that the documents filed do not comply with the Board’s Model Directive on Procedure and Practice Notice PN 2019-001. The following deficiencies have been noted:

1. The PDF documents filed are not in searchable format.

2. The header and footer of the documents indicate that the agreement is designated as highly confidential information, however, the relevant highly confidential information is not highlighted in blue in the text. For clarity, note that the information for which confidential treatment is sought shall be specifically identified. Confidential treatment cannot be sought in respect of an entire document. A public version of the document shall also be produced.

[4] Moreover, we have noticed that the July 6, 2016 Agreement mentions that paragraph 11 has been intentionally omitted. The Board inquires whether some information is missing from this document. As such, parties are required to confirm whether the text of paragraph 11 is missing and if so, provide such text.

[5] Parties shall answer the question and provide the Board with documents that comply with the requirements mentioned above by April 14, 2022.
