RULING OF THE BOARD

 

File: Online Music Services (SOCAN: 2007-2018)

 

April 14, 2022

 

[1] Pandora’s request for a suspension of Pandora filing deadline pending resolution of a confidentiality issue is granted under the following framework:

1. Pandora shall file by April 20, 2022, a short submission on the confidentiality issue;

2. SOCAN shall file a short response by April 22, 2022, at noon at the latest;

3. To the extent the confidentiality issue also concerns CSI and Re:Sound, whose highly confidential respective information may have been accessed by Pandora at previous stages of the proceedings, CSI and Re:Sound may file a short response by April 22, 2022, at noon at the latest;

4. The Honourable Luc Martineau will hold an oral hearing by teleconference on Monday, April 25, 2022, at 10 a.m. with details to follow;

5. Should the parties resolve the issue prior to the hearing, they shall inform the Board forthwith;

6. Procedural deadlines will be adjusted in fairness and in light of the fixed dates for the hearing and for the final submissions.
