ORDER OF THE BOARD

 

File: Online Audiovisual Services – Music (2007–2018)

May 20, 2022

 

Further to Notice CB-CDA 2022-014, I am ordering the following:

I. Order: Proposed Tariffs 22.5/22.E/22.F will not be considered in this proceeding

[1] Pursuant to Order CB-CDA 2021-047, only the following portions of the 22.5/22.E/22.F series of proposed tariffs currently remain in this proceeding:

· SOCAN Tariff 22.5 – Webcasts of Television Station Signals (2007, 2008) [except as applicable to allied audiovisual services];

· SOCAN Tariff 22.E – Webcasts of Television Station Signals (2009, 2010, 2011, 2012) [except as applicable to allied audiovisual services]; and

· SOCAN Tariff 22.F – Webcasts of Television Station Signals (2013) [except as applicable to allied audiovisual service].

[2] In response to Order CB-CDA 2021-047, SOCAN indicated that there are no users, to its knowledge, that would be covered by the above identified portions of proposed tariffs.

[3] Since there are no users, I conclude that there is nothing left to consider in respect of these proposed tariffs. Hence, these are removed from consideration in this proceeding.

[4] Any party that filed an objection to “SOCAN 22” for any of the years from 2007 to 2013, inclusive (without specifying a sub-portion) is no longer a participating objector in this proceeding by reason of such an objection alone.

II. Order: Objectors will confirm participation for each proposed tariff

[5] By no later than Friday, June 3, 2022, the Objectors shall confirm their continued participation in respect of the proposed tariffs for which they are listed in the Annex.

[6] Objectors who fail to provide such confirmation will be considered to have withdrawn from participation in this proceeding.

III. Notice : informal meeting

[7] To assist with the subsequent development of a Statement of Issues, the Parties are invited to attend an informal meeting with Board Staff.

[8] The purpose of the discussion will be to identify and describe the potential substantive issues that the Parties believe the Board should consider in this proceeding.

[9] Please indicate by Friday, June 3, 2022, which of the following days you or your representative would be available, and the name(s) of the designated participant(s) :

1. June 7, 2022, 10:30 a.m. to 11:30 a.m.

2. June 8, 2022, 1:30 p.m. to 2:30 p.m.

3. June 9, 2022, 2:00 p.m. to 3:00 p.m.

IV. order : statement of issues

[10] By no later than 30 days after the date of the above-mentioned informal meeting, all Parties shall, jointly or separately, file a Statement of Issues to be considered by the Board in this proceeding.

[11] Each Statement will contain a list of issues that the party or parties submit the Board should resolve in this proceeding, along with a brief description of the issue.

[12] The purpose of the Statement(s) of Issues is primarily to permit the Board to take steps to reduce the scope of interrogatories. The Board may, for example, use the Statement(s) of Issues to

· limit interrogatory questions to only those that are directly relevant to an identified issue; and

· hold a preliminary hearing with a view to resolving one or more of these issues in whole, or in part.

[13] The Statement(s) of Issues will not prevent a party from raising other issues subsequent to the interrogatory process.

[14] For certainty, the Board may consider relevant issues other than those identified by the Parties in the Statement(s) of Issues to be considered.
