NOTICE OF THE BOARD

[1] Having received the Parties’ Statements of Case, the Board will establish a Hearing Schedule.

[2] For this purpose, a Draft Hearing Schedule is provided to the Parties for comment.

[3] Parties are reminded that pursuant to its Practice Notice on Sworn Statements or Solemn Declarations by Fact Witnesses in Oral Hearings [PN 2019-003], oral hearings before the Board will not include examinations in chief of fact witnesses, unless permitted by the Board.

[4] Unless the Board indicates otherwise, participation will be fully virtual.

[5] The day for Closing Arguments will be fixed at a later date, likely after examination of witnesses has been completed. This date will be fixed in consultation with the Parties, with the aim of ensuring that any undertakings that may be given during witness examination have been completed prior to Closing Arguments. As indicated in Order CB-CDA 2022-045, this will—in all cases—be no later than January 23, 2023, the date currently fixed for Final Submissions.

[6] Any comments are to be filed by Wednesday, August 17, 2022.

[7] The Board will subsequently issue a Hearing Schedule.
