[1] The proposed revised schedule is accepted, with the following condition: The fact witnesses may have a “warm-up phase” but this step is not to be used to testify on, or supplement, the substance of their sworn statements.
[2] Furthermore, the Board notifies the parties that a document that is not part of a case record, a response to a case record or a reply to a response to a case record will not be received as evidence at the oral hearing unless it is to be used only for the purposes of cross-examination of a witness or the Board permits it to be received as evidence.
