NOTICE OF THE BOARD
File: Online Allied Services (SOCAN – 22.D.3)(2007-2013)

[1] The Board is providing a draft Tariff to the Parties for consultation on wording.
[2] In Notice CB-CDA 2022-039, the Board indicated that it intends to use the Parties’ jointly submitted text as a basis for the Tariff. However, the Board also indicated that it identified potential issues that may require changes to this text. Subsequently, the Parties participated in an informal, technical meeting with the Staff.
[3] On the basis of that meeting, the Panel has prepared a draft Tariff for the Parties’ formal, written comments.
[4] For ease of reference, we have included both the draft Tariff, and a blackline document comparing changes from the jointly-submitted text with the draft Tariff.
[5] Of particular note are the following changes:
· modifications to clarify that the Tariff is applicable only to entities that are members of CAB, as per the Board’s ruling SOCAN 22.D.3 (2007–2018), 2020 CB 003, that operate an Allied Audiovisual Service or authorize another entity to carry out those services;
· removal of references to other tariffs, in-line with Practice Notice on Filing of Proposed Tariffs [PN 2019-004 rev. 2];
· modifying the structure to make explicit that the minimum royalties are applicable for Low-Use rates as well.
[6] Any comments must be provided by November 12, 2022.
