ORDER OF THE BOARD

 

Proceeding: Re:Sound Tariff 5.A to 5.J – Live Events (2016-2020)

April 18, 2023

[1] As a means to manage more efficiently its current backlog, the Board has decided to prioritize the approval of proposed tariffs with effective periods prior to 2019; and to consider, when and if appropriate, consolidating the examination of such proposed tariffs with more recent proposed tariffs covering the same activities.

[2] To this end, the Board requires additional information from Parties currently engaged in settlement discussions.

[3] In March 2018, Re:Sound advised the Board that it had initiated settlement discussions with the objectors to the Re:Sound Tariff 5.A to 5.J (2016-2020) proposed tariff. As per Notice CB-CDA 2018-193, Re:Sound has been filing monthly reports on the status of its negotiations since November 2018. A proposed tariff has subsequently been filed by Re:Sound for the years 2021-2025.

[4] As such, Re:Sound shall provide the following information, by Wednesday, May 10, 2023, at the latest:

a. A progress report on the negotiations for the 2016-2020 period for each of the 10 parts of the proposed tariff (parts A-J), including which objectors are involved, in which part, and at which stage (e.g. initial discussions, identification of issues, terms of settlement, agreement in principle, etc.);

b. Whether Re:Sound has entered into negotiation with objectors to the 2021-2025 proposed tariff and whether it believes the 2021-2025 period will be part of its agreement(s);

c. Estimated timeline(s) of the next steps required to conclude the negotiations for each part of the proposed tariff, including a potential date of filing any jointly-submitted text(s) with the Board.

[5] Additionally, this order varies Notices CB-CDA 2018-193 and CB-CDA 2018-211: monthly reports are hereby no longer required. The Board will advise Parties of new reporting requirements in due time, based on the information provided in response to this Order.
