ORDER OF THE BOARD

Proceeding: SOCAN Tariff 6 – Motion Picture Theatres for the years 2017, 2018, 2019, 2020-2021 and 2022-2024

May 30, 2023

[1] Following Order CB-CDA 2023-009, SOCAN and MTAC have requested a further three-month extension to the suspension period in order to continue settlement discussions.

[2] The proposed tariffs engaged in the settlement discussions include periods covering the years 2017, 2018 and 2019. In order to manage its current backlog more efficiently, the Board has decided to prioritize the consideration of proposed tariffs with effective periods that start prior to 2019. As such, the Board requires additional information from the Parties in order to determine the appropriate next steps, which may include the commencement of a proceeding.

[3] The Parties shall report back to the Board on or before Wednesday, August 30, 2023.

[4] In their report to the Board, the Parties shall provide the following information:

a. A progress report on the settlement discussions and stage reached in their discussions (e.g. identification of issues, terms of settlement, agreement in principle, etc.);

b. Estimated timeline(s) of the next steps required to conclude settlement discussions, including a potential date of filing any jointly-submitted text(s) with the Board.

[5] Based on the information provided in response to this order, the Board will decide on commencing a proceeding for the consideration of the proposed tariffs, including when the Board would require the Parties to file a joint statement of issues as per Rule 24 of the Copyright Board Rules and Procedures.
