NOTICE OF THE BOARD

Proceeding: SOCAN Tariff 4.A – Live Performances at Concert Halls, Theatres and other Places of Entertainment - Popular Music Concerts (2018-2024)

[1] On January 17, 2023, the Board received comments from the Rideau Association in respect of this proceeding.

[2] Under subrule 53(3) of the Copyright Board Rules of Practice and Procedure, the Board must provide all parties with a copy of any letter of comment and place a copy of the letter on its public record of the proceeding.

[3] The Rideau Association filed with the Board two documents:

· A letter from Julie-Anne Richard, the director general of the Rideau Association; and

· A legal memoranda prepared by Normand Tamaro on behalf of the Rideau Association.

[4] The Board is preliminarily of the view that is not able to make a determination in the context of a tariff of general application on the issue raised by the Rideau Association. Accordingly, the question raised by the Rideau Association is a matter of enforcement and outside the Board’s jurisdiction. As a result, parties shall limit their response, if any, to two pages.

[5] Under subrule 53(4), parties have 15 days to file a response with the Board and serve a copy of that response on all parties. Therefore, the parties may file a response with the Board no later than Wednesday, September 20, 2023.
