ORDER OF THE BOARD

 

Proceeding: Online Audiovisual Services – Music (2014-2026)

 

October 19, 2023

 

[1] On October 18, 2023, Google filed a request for leave to intervene in respect of SOCAN 22.D.1. Google is already an objector in this proceeding in relation to proposed tariffs SOCAN 22.D.2 (2019, 2020, 2021-2023, 2024-2026).

[2] I acknowledge receipt. At this point, despite Rule 52(4), parties are not to make submissions with respect to Google’s request.

[3] As a reminder, Notice 2017-153 stated that:

In line with Order 2017-126, any party in these proceedings that did not formally object to a particular proposed tariff – or for which it did not get intervenor status with full participatory rights and obligations – will not be able to act solely in relation to that proposed tariff. The Board will rely on counsel to raise objections as necessary. However, a party that did not object to a proposed tariff may still file comments in respect of a tariff to which it did not object at any point before the close of proceedings. In addition, any party may file a request to be granted intervenor status with full participatory rights and obligations in relation to any of the proposed tariffs under consideration.

[4] The role of objectors and intervenors in this proceeding is an issue that will be addressed at a forthcoming case management conference. I believe it would be premature to rule on Google’s request prior to that time.
