RULING OF THE BOARD
Proceeding: Online Music Video Services (2014-2018)

I. OVERVIEW
[1] On October 4, 2023, I received a request from SiriusXM to intervene in this proceeding. SiriusXM explains that it “intends to focus its submissions on ensuring that any certified tariff takes into account minor uses of music videos by services predominantly engaged in other activities.”
[2] I have received no submissions from other parties regarding SiriusXM’s request.
[3] SiriusXM’s request is granted.
II. ANALYSIS
[4] I am of the view that SiriusXM’s request is timely, as required by Rule 52(2). The scope of this proceeding was set on September 13, 2023. No further procedural steps have taken place.
[5] Furthermore, I have considered the elements in Rule 52(3) and conclude that these weigh in favour of SiriusXM’s request. In particular, SiriusXM’s participation will likely be used to address issues that may not be addressed by others, and SiriusXM’s requested procedural rights are limited.
[6] Moreover, there is already one intervener in this proceeding with similar procedural rights, and I do not expect that SiriusXM’s intervention will interfere with the fair and expeditious conduct of the proceeding.
III. RULING
[7] SiriusXM is granted intervener status in this proceeding. SiriusXM
shall receive a digital copy of the record; and
may file written submissions and make oral submissions on the date or dates fixed by the Board for such purposes.
