ORDER OF THE BOARD
Online Music Video Services (2014-2018)
October 30, 2023
[1] I will hold a case conference in the Online Music Video Services (2014-2018) proceeding.
[2] Stingray has confirmed their participation as objector. Apple has previously been granted intervener status (Order 2022-040). I have recently granted SiriusXM intervener statuts (Ruling 2023-052).
[3] The purpose of the case conference is to discuss the following :
- Will SOCAN and SODRAC act as one party or two?
- The rôle of the interveners, Apple and Sirius XM.
- What should the schedule of proceeding be? A preliminary calendar is included in the Annex for Parties’ comments.
- Any other procedural issues the Parties wish to bring to my attention.
[4] Despite Order 2022-040, interveners will be permitted to participate in the case conference.
[5] I am of the preliminary view that this proceeding can be considered by way of a written hearing, with limited interrogatories (only with leaves); the interveners’ role should be limited to filing written submissions. The preliminary calendar reflects this.
[6] Given Parties’ responses, this proceeding will be in English.
[7] I am available at the following dates and times:
· Monday, November 20, 2023 at 2:00 p.m. EST
· Wednesday, November 22, 2023 at 10:00 a.m. EST
· Monday, November 27, 2023 at 2:00 p.m. EST
[8] The case conference will be one hour in length and be held virtually.
[9] Parties are to indicate their availability by no later than Tuesday, November 7, 2023.
