Notice Pursuant to Section 5 of the Time Limits in Respect of Matters Before the Copyright Board Regulations

February 15, 2024

 

Proposed Tariffs for Which the Board Will Hold a Hearing

[1] Pursuant to Section 5 of the Time Limits in Respect of Matters Before the Copyright Board Regulations (SOR/2020-264) (“the Regulations”), the Board hereby notifies the collective societies and any person or entity having filed an objection to any of the proposed tariffs for the years 2025 and beyond that a hearing will be held in respect of the following proposed tariffs:

  • CMRRA – Audiovisual Services Tariff (2025-2027)

 

  • CPCC – Private Copying Tariff (2025-2027)

 

  • Re:Sound Tariff 1.B – Non-Commercial Radio, Simulcasting, Non-Interactive and Semi-Interactive Streaming (2025-2029)

  • Re:Sound Tariff 1.C – CBC Radio and Simulcasts (2025-2029)

  • Re:Sound Tariff 3.C – Aircraft (2025-2029)

  • Re:Sound Tariff 4 – Satellite Radio Services (2025-2029)

  • Re:Sound Tariff 8 – Non-Interactive and Semi-Interactive Streaming (2025-2027)

 

  • SOCAN Tariff 1.A – Commercial Radio (2025-2027)

  • SOCAN Tariff 1.B – Radio - Non-Commercial Radio other than the Canadian Broadcasting Corporation (2025-2027)

  • SOCAN Tariff 2.A – Commercial Television Stations (2025-2027)

  • SOCAN Tariff 2.A.R – Commercial Television Reproduction Tariff (2025-2027)

  • SOCAN Tariff 3.A – Cabarets, Cafes, Clubs, Cocktail Bars, Dining Rooms, Lounges, Restaurants, Roadhouses, Taverns, and Similar Establishments - Live Music (2025-2027)

  • SOCAN Tariff 4.A – Live Performances at Concert Halls, Theatres, and Other Places of Entertainment - Popular Music Concerts (2025-2027)

  • SOCAN Tariff 4.B – Live Performances at Concert Halls, Theatres, and Other Places of Entertainment - Classical Music Concerts (2025-2027)

  • SOCAN Tariff 5.A – Exhibitions and Fairs (2025-2027)

  • SOCAN Tariff 5.B – Concerts at Exhibitions and Fairs - (2025-2027)

  • SOCAN Tariff 6 – Motion Picture Theatres (2025-2027)

  • SOCAN Tariff 15.A – Background Music in Establishments Not Covered by Tariff No. 16 - Background Music (2025-2027)

  • SOCAN Tariff 15.B – Background Music in Establishments Not Covered by Tariff No. 16 - Telephone Music on Hold (2025-2027)

  • SOCAN Tariff 16 – Background Music Suppliers (2025-2027)

  • SOCAN Tariff 17 – Transmission of Pay, Specialty and Other Television Services by Distribution Undertakings (2025-2027)

[2] The Board will provide, in due time, further direction for the examination of each of the proposed tariffs, including whether related hearings will be oral or written, or both.

[3] In order to increase the efficiency of its proceedings, the Board generally favours written hearings and written submissions, and proceeds by oral hearing only when deemed necessary.

Proposed Tariffs for Which the Board Will Not Hold a Hearing

[4] The Board considers a number of factors to determine whether a hearing should be held in respect of proposed tariffs. This year, the factors considered include the following:

· Whether there were previous unapproved proposed tariffs covering the same or substantially the same activities;

· Whether there were any objections filed in respect of the proposed tariffs;

· Whether the proposed tariffs include substantive changes from the previously approved tariff covering the same or substantially the same activities; and

· Whether the Board is aware of any circumstances, including potential changes in the market place, that may require evidence or submissions.

[5] The Board hereby gives notice that no hearing will be held in respect of the following proposed tariffs:

  • SOCAN Tariff 14 – Performance of an Individual Work (2025-2027)

  • SOCAN Tariff 23 – Hotel and Motel In-Room Services (2025-2027)

[6] Consequently, as per paragraph 2(b) of the Regulations, the Board will issue its decisions with respect to these proposed tariffs before their effective period begins; that is, before January 1, 2025.
