NOTICE OF THE BOARD

Matters: Applications to Vary ̶ Interim Television Retransmission Tariff (2019-2023) and Interim Television Retransmission Tariff (2024-2028)

February 29, 2024

[1] On February 23, 2024, several Objectors to the Tariff for the Retransmission of Distant Television Signals (2019-2023) and Tariff for the Retransmission of Distant Television Signals (2024-2028) —Bell Canada, Cogeco Communications, Quebecor Media, Rogers Communications, Canadian Communications Systems Alliance Inc., and TELUS Communications (the “BDUs”)—wrote to the Board with two requests:

- that the Board vary two interim tariffs: the Interim Television Retransmission Tariff (2019-2023) (issued February 22, 2019) and the Interim Television Retransmission Tariff (2024-2028) (issued December 21, 2023); and

- that the Board combine the 2019-2023 and 2024-2028 Television Retransmission proceedings into a single proceeding, and commence at the Board’s earliest convenience.

[2] With respect to the request to vary, the BDUs ask that the Board substitute the rates in those interim tariffs with those approved by the Board on January 12, 2024 for the years 2014-2018.

[3] The interim tariffs correspond to tariffs proposed for the years 2019-2023 and 2024-2028 by nine collective societies—Border Broadcasters, Inc., Canadian Broadcasters Rights Agency, Copyright Collective of Canada, Canadian Retransmission Collective, Canadian Retransmission Right Association, Direct Response Television Collective Inc., FWS Joint Sports Claimants Inc., Major League Baseball Collective of Canada, and the Society of Composers, Authors and Publishers of Music of Canada (“the Collectives”).

[4] The Collectives may respond to the BDU’s request to vary the interim tariffs by Thursday, March 14, 2024.

[5] I have noted the BDUs’ request to consolidate and commence consideration of the proposed tariffs. The Board will not be addressing the request at this time. When it is ready to proceed, the Board will inform the Parties. As such, I am not seeking a response from the Collectives to this aspect of the BDUs’ request.
