ORDER OF THE BOARD

 

Proceeding: SOCAN Tariffs 15 and 16 – Background Music (2012-2018)

April 12, 2024

I. Overview

[1] On September 21, 2023, the Parties jointly requested that a confidentiality order be issued in this proceeding. On December 22, 2023, a proposed confidentiality order was filed with the Board.

[2] After further consultation, SOCAN confirmed that all parties agreed to the proposed confidentiality order on April 10, 2024.

[3] The proposed order is appropriate in this context: all current participants are permitted to view all the information that will be designated as confidential or highly confidential. It also matches the language recently used by the Board in similar cases (e.g., CB-CDA 2023-034).

[4] I therefore issue the Order as filed by SOCAN.

II. ORDER DEALING WITH INFORMATION FOR WHICH CONFIDENTIAL TREATMENT MAY BE CLAIMED

1. This order applies to documents and information that any party designates as confidential or highly confidential.

2. Pursuant to the Practice Notice PN 2019-001 rev.1 on Format of Electronic Documents, a party may designate information as (i) confidential by highlighting that information only in yellow (ii) highly confidential by highlighting that information only in blue. All highlighted text should be clearly legible.

3. Where an entire page is confidential or highly confidential, either a yellow or blue page colour should be applied, respectively, to that page only.

4. Any party to this proceeding may file confidential or highly confidential information pursuant to this order

5. This order does not in any way restrict a party from using documents or information that it has designated confidential. Further, this order does not restrict a party from using documents that it has supplied or to which it is a signatory.

6. In the event that additional parties are added to this proceeding, any party may file a request with the Board to modify this order.
