NOTICE OF THE BOARD

Matter: 71-2020-01 SiriusXM v CMRRA

I. backround

[1] SiriusXM filed on July 29, 2020, an application under section 71 of the Copyright Act
(“the Application”) to fix the royalty rates and related terms and conditions in respect of its use of CMRRA’s repertoire of musical works, for the purpose of carrying out its satellite radio and internet music services from April 1, 2020, to March 31, 2025.

[2] SiriusXM also requested an interim licence pursuant to section 66.51 of the Act authorizing SiriusXM to use CMRRA’s repertoire in the provision of its services until a final decision is rendered in respect of the Application.

[3] On March 25, 2024, the parties notified the Board that

“[…]the parties have decided to settle the above-identified matter.

Accordingly, with the consent of CMRRA, Sirius XM Canada Inc. withdraws its:

1. Application to Fix Royalties and Terms in an Individual Case pursuant to s. 71

2. Interim Relief Request pursuant to s. 66.51”

II. Conclusion

[4] The Board takes note of the withdrawal of both requests and will not proceed with their consideration.
