ORDER OF THE BOARD
Matters: SOCAN Tariff 19 – Fitness Activities and Dance Instruction (2018); Physical Exercises and Dance Instruction (2019, 2020-2022)
April 22, 2024
On February 7, 2024 the Board ordered the Objectors in the above matters to file Notice of Grounds for Objections no later than April 8, 2024 (Order 2024-010).
GoodLife Fitness informed the Board of their intent to withdraw as participants on February 12, 2024. SOCAN and the other objectors do not appear to have been notified of this withdrawal as they were not copied on the email received by the Board.
On April 8, 2024, an Objector, the Fitness Industry Council of Canada (“FIC”), called the Registry and followed up by email on April 9, 2024, requesting an extension to the deadline to file their Notice of Grounds. FIC stated that it had only recently learned of GoodLife’s decision to withdraw. FIC asks for additional time to reassess their position and strategy in objecting to the proposed tariffs.
FIC’s request for an extension is granted. FIC remains a participant in these matters and shall file their Notice of Grounds for Objection no later than Friday, May 17, 2024. If FIC does not file a Notice of Grounds by this date, it will be deemed as not participating in consideration of the proposed tariffs.
SOCAN may file a reply to any Notice of Grounds for Objection no later than Friday, May 31, 2024.
