ORDER OF THE BOARD

 

Matters: Re:Sound Tariff 5.A to 5.J – Live Events (2016-2020); Re:Sound Tariff 5.A to 5.J – Live Events (2021-2025)

February 7, 2024

[1] On October 31, 2023, the Board issued Order CB-CDA 2023-055 in which Re:Sound was asked to provide a status update addressing the progress made in their settlement discussions with Restaurants Canada and Hotel Association of Canada and provide an estimated timeline for the conclusion of those discussions.

[2] Order CB-CDA 2023-055 also requested that the Federation of Calgary Communities and the Retail Council of Canada confirm their interest in participating in the consideration of the proposed tariffs. Both parties have failed to respond to the order. As such they will now be considered as not participating in the consideration of the proposed tariffs.

[3] In its response to Order CB-CDA 2023-055 dated January 29, 2024, Re:Sound informs the Board that it has executed a settlement agreement with CAPACOA, CAFE and CLMA and proposes to file the agreement and draft tariffs with the Board at the same time as the other agreements with respect to Tariff 5.

[4] Re:Sound also informs the Board that it is continuing to finalize the terms of their settlement agreements and draft tariffs with the Sports Objectors and Québecor and anticipate being able to file the draft tariffs with the Board within 2 months’ time.

[5] In respect of Restaurants Canada and Hotel Association of Canada, Re:Sound informs the Board that negotiations are ongoing but that they have yet to reach an agreement in principle and that it is too early to estimate when (or if) discussions will be concluded. Re:Sound proposes to provide a further update on its discussions within 2 months’ time.

[6] No later than Friday, April 5, 2024, Re:Sound shall file a status update addressing the progress made in their settlement discussions with Restaurants Canada and Hotel Association of Canada and provide an estimated timeline for the conclusion of those discussions.

[7] By that same date Re:Sound shall inform the Board if they have finalized their agreements with the Sports Objectors and Québecor.
