NOTICE OF THE BOARD
Proceeding: CPCC – Private Copying Tariff (2025-2027)
June 25, 2024
[1] In response to CPCC’s correspondence dated June 12, 2024, the Board agrees to schedule a technical assistance meeting.
[2] Similar to the Case Management Conference, this meeting is not intended to review or provide an opinion on CPCC’s proposed survey. Instead, it is designed to offer assistance with any technical issues in addressing the Board's questions raised in Notice [CB-CDA 2024-029].
[3] I want to reiterate that CPCC is free to decide how it intends to address these questions. I do not impose any framework or methodology, including conducting a survey, to answer the Board’s questions.
[4] In general, providing specific answers or expected outcomes from a survey, advising on how to present evidence to favour a particular finding, or engaging in strategic planning for a party's case would exceed acceptable assistance. Such actions could undermine the Board’s neutrality and the independence of the adjudicative process.
[5] I would also like to emphasize that any technical assistance offered by Board staff should not be construed as an endorsement or particular position by the Panel with respect to any conclusions derived from a survey or other methodology developed following such technical meeting. Additionally, I emphasize the necessity of maintaining an arm's length relationship between the Board and any involved parties. Actions that could compromise the Board's impartiality or create a perception of bias must be avoided.
[6] I would like to receive a proposed list of technical issues prior to the technical assistance meeting.
[7] CPCC should file its technical issues by Tuesday, July 9, 2024.
[8] The meeting will be scheduled, shortly after receipt of CPCC’s technical issues.
