NOTICE OF THE BOARD

Matters: Non-Commercial Radio Reproduction Tariffs [CSI: 2018 ; CMRRA/SOCAN: 2020, 2021-2023, 2024-2026]

October 2, 2024

[1] On March 10, 2020, the collectives and the Alliance des radios communautaires du Canada, the Association des radiodiffuseurs communautaires du Québec and the National Campus and Community Radio Association (the “Associations”) informed the Board that they had reached an agreement with respect to the reproductions of musical works in the repertoire of the collectives by non-commercial radio stations in Canada for the years 2003 to 2023.

[2] In connection with the execution of this agreement, the collectives and the Associations jointly requested that the Board approve the proposed tariffs in the form of three jointly-submitted texts for the years 2003-2010, 2011-2018 and 2020 to 2023.

[3] On October 7, 2021, the Board informed the parties that it would examine the proposed tariffs in two separate proceedings, one for the years 2003-2017, the other for the years 2018 and 2020-2023.

[4] On September 3, 2022, the Board approved the Non-Commerciale Radio Reproduction Tariff (2003-2017).

[5] On October 17, 2022, CMRRA and SOCAN filed their proposed tariff for the years 2024-2026.

[6] The Board is now ready to resume the examination of the proposed tariffs for the years 2018 and 2020-2023.

[7] Given that the rates and terms and conditions of the proposed tariff for the years 2024-2026 are identical to those of the proposed tariff for the years 2021-2023, the Board is of the view that it should consider the proposed tariff for 2024-2026 with the proposed tariffs for 2018 and 2020-2023.

[8] The collectives and the Associations may comment on the Board’s intention to consider the proposed tariff for 2024-2026 with the proposed tariffs for 2018 and 2020-2023 by Wednesday, October 16, 2024.
