ORDER OF THE BOARD

Proceeding: Online Music Video Services (2014-2018)

November 8, 2024

[1] On November 1, 2024, SOCAN and Stingray informed me that they have reached an agreement.

[2] In accordance with Ruling CB-CDA 2024-071, the current Schedule is suspended. I will hold a Case Management Conference to determine how the current Schedule should be modified; all Parties may attend.

[3] At the Case Management Conference, Stingray should be ready to address whether it will remain a participating objector in this proceeding; this may inform which steps are no longer necessary. SOCAN should be ready to address whether it intends to withdraw one or more of the Proposed Tariffs, or a portion thereof and whether it intends to rely on the agreement in its Case Record; these may inform appropriate new dates. In the event that the agreement between SOCAN and Stingray has been shared with Apple and SiriusXM, the latter are expected to inform me if they will continue their participation. Finally, Parties are to review Ruling CB-CDA 2024-059 and inform me, if possible, if any of the issues in the Joint Statement of Issues are no longer relevant.

[4] I intend that the Case Management Conference occur on or about the week of December 9, 2024. The Registry will communicate with the Parties to determine an appropriate date and time.
