ORDER OF THE BOARD
Proceeding: SOCAN – Background Music (2012-2019)
[1] In its October 23, 2024, reply to the Board’s Order 2024-079, SOCAN requested that the year 2019 be added to the current proceeding. This request was supported by the BDUs in their November 6, 2024, letter to the Board.
[2] The Board hereby confirms that the year 2019 will be added to the current proceeding.
[3] The Board, however, notes that there are remaining objectors to the SOCAN Background Music Tariffs for the year 2019, that are not part of the request to approve the tariffs on the basis of the Jointly Submitted Texts (JSTs):
· Fitness Industry Council of Canada (Tariffs 15.A and 16)
· GoodLife Fitness Centre (Tariffs 15.A and 16)
· Sirius XM Canada (Tariff 16)
[4] The remaining objectors shall confirm no later than Friday, January 10, 2025 if they intend to participate in the current proceeding. If so, they must provide, by that same date, a Notice of Grounds for their objection, taking into account the JSTs.
[5] The Board also notes that Stingray, which is a party to the agreement for Tariff 16, filed objections to Tariffs 15.A and 15.B for 2012 to 2019. To the extent that Stingray wishes to continue its participation in respect of Tariff 15.A and 15.B, it shall provide no later than Friday, January 10, 2025, a Notice of Grounds for its objections taking into account the JSTs.
[6] The following documents are attached for convenience:
· SOCAN Submissions and JSTs from September 21, 2023;
· Order CB-CDA 2024-079;
· SOCAN’s and the BDUs’ responses to the above Order.
[7] Lastly, the Board asks SOCAN to file at its earliest convenience the French versions of the Jointly Submitted Texts (JSTs).
