Case Management Conference postponed to January 2025

[1] On November 8, after being informed that SOCAN and Stingray have reached an agreement related to the Proposed Tariffs, I suspended the current Schedule and ordered a case management conference (Order CB-CDA 2024-093). The primary purpose of the Case Management Conference was to determine what modifications to the Schedule may be appropriate.

[2] On December 3, SOCAN, with the consent of Stingray, requested that the Case Management Conference be rescheduled to January 2025. They state that

[i]t is possible that the settlement agreement will not be finalized and executed in time for the Case Management Conference as currently scheduled […] SOCAN and Stingray are of the view that the Case Management Conference is likely to be more productive if it is scheduled after the agreement is finalized and executed.

[3] I grant this request. The Case Management Conference will be held on the week of January 20, 2025. I am available for the CMC at the following dates and time:

· Wednesday, January 22, 2025 from 1 to 2 p.m. EST

· Thursday, January 23, 2025 from 1 to 2 p.m. EST

· Friday, January 24, 2025 from 1 to 2 p.m. EST

Parties are to confirm their availability at the proposed dates and times by Friday, December 13, 2024.

SOCAN and Stingray to file information prior to Case Management Conference

[4] Furthermore, SOCAN and Stingray will file the following information prior to the Case Management Conference:

- whether Stingray will remain a participating objector in this proceeding;

- whether SOCAN intends to withdraw one or more of the Proposed Tariffs, or a portion thereof; and

- whether SOCAN intends to rely on the agreement in its Case Record;

[5] SOCAN and Stingray may also file

- the agreement between SOCAN and Stingray;

- any other information that may assist Apple or SiriusXM in determining whether to continue their participation; and

- any other information that may assist me in determining any appropriate modifications to the Schedule.

[6] SOCAN and Stingray may file their information jointly or separately. Any such filings are to be made by Monday, January 13, 2025.
