Order of the Board

Proceeding: Online Music Video Services (2014-2018)

January 27, 2025

[1] I held a Case Management Conference on January 23, 2025, to determine the next appropriate steps in this proceeding. Present were SOCAN and the Intervenors, Apple and SiriusXM.

[2] SOCAN stated that it intends to file a revised request for approval. Additionally, SOCAN has previously informed the Board and the Parties that it intends to withdraw the portions of the SODRAC 6 Proposed Tariffs under consideration in this proceeding.

[3] These two developments may have a significant impact on which issues, if any, remain to be considered in this proceeding. In turn, identifying any remaining issues will help inform the procedural steps required after that.

[4] I agree with the Parties that these two steps should come first, and that it is premature to fix any steps beyond these at this time.

[5] SOCAN stated that it believes it would be able to file its revised request for approval within 2 weeks.

[6] SOCAN shall do so by Monday, February 10, 2025.

[7] SOCAN and the Intervenors shall jointly or separately make submissions on which issues previously identified in Ruling CB-CDA 2024-059 remain relevant by Monday, March 3, 2025. If submissions are filed separately, responses to such submissions may be filed by Monday, March 10, 2025.
