Notice Pursuant to Section 5 of the Time Limits in Respect of Matters Before the Copyright Board Regulations

I. Proposed Tariffs for Which the Board Will Not Hold a Hearing
[1] Pursuant to Section 5 of the Time Limits in Respect of Matters Before the Copyright Board Regulations (SOR/2020-264) (“the Regulations”), the Board hereby notifies the collective societies and any person or entity having filed an objection to any of the following proposed tariffs, published by the Board on November 15, 2024, that a hearing will be held in respect of these proposed tariffs:

SOCAN Tariff 10.A – Parks, Parades, Streets and Other Public Areas - Strolling Musicians and Buskers; Recorded Music (2026-2028)
SOCAN Tariff 10.B – Parks, Parades, Streets and Other Public Areas - Marching Bands; Floats with Music (2026-2028)
SOCAN Tariff 11.A – Circuses, Ice Shows, Fireworks Displays, Sound and Light Shows, Dance Shows and Similar Events (2026-2028)
SOCAN Tariff 13.A – Public Conveyances - Aircraft (2026-2028)
SOCAN Tariff 18 – Recorded Music for Dancing (2026-2028)
SOCAN Tariff 19 – Physical Exercises and Dance Instruction (2026-2028)
SOCAN Tariff 20 – Karaoke Bars and Similar Establishments (2026-2028)
SOCAN Tariff 26 – Pay Audio and Ancillary Services (2026-2028)
[2] The Board will provide, in due time, further direction for the examination of each of the proposed tariffs, including whether related hearings will be oral or written, or both.
[3] In order to increase the efficiency of its proceedings, the Board generally favours written hearings and written submissions, and proceeds by oral hearing only when deemed necessary.
II. Proposed Tariffs for Which the Board Will Not Hold a Hearing
[4] The Board hereby gives notice that no hearing will be held in respect of the following proposed tariffs, also published by the Board on November 15, 2024:
SOCAN Tariff 3.C – Adult Entertainment Clubs (2026-2028)
SOCAN Tariff 7 – Skating Rinks (2026-2028)
SOCAN Tariff 11.B – Comedy Shows and Magic Shows (2026-2028)
SOCAN Tariff 12.A – Theme Parks and Water Parks (2026-2028)
SOCAN Tariff 12.B – Canada’s Wonderland and Similar Operations
(2026-2028)SOCAN Tariff 13.B – Public Conveyances - Passenger Ships (2026-2028)
SOCAN Tariff 13.C – Public Conveyances - Railroad Trains, Buses and Other Public Conveyances, Excluding Aircraft and Passenger Ships (2026-2028)
SOCAN Tariff 21 – Recreational Facilities Operated by a Municipality, School, College, University, Agricultural Society or Similar Community Organizations (2026-2028)
[5] Consequently, as per paragraph 2(b) of the Regulations, the Board will issue its decisions with respect to these proposed tariffs before their effective period begins; that is, before January 1, 2026.
