Proceeding: Television Retransmission Tariff (2019-2028)

February 10, 2025

I. Background

[1] A case management conference (CMC) was held on January 28, 2025, following Orders CB-CDA 2024-105 and CB-CDA 2025-006.

[2] The purpose of the CMC was essentially two-fold: Whether the Notices of Grounds for proposed tariff and objection (NoGs) for 2024-2028 may apply to 2019-2023; and whether a three-phased approach was appropriate.

II. 2019-2023 Notices of Grounds

[3] The Parties agreed that the same NoGs (subject to the necessary adjustments) can apply to both periods. They also agreed that there would be a single case record applying to both periods.

III. Proceeding Format

[4] There was a consensus among the Parties that a three-phased approach was not appropriate.

[5] The Parties indicated that, while they understood and shared the Board’s objective of ensuring an efficient proceeding, they felt it would be more efficient to gather information on the state of the relevant market and assess how protected content is valued by users before selecting any methodology to determine the appropriate rate.

[6] In keeping with the goal of efficiency, the Parties proposed different ways to circumscribe the information-gathering process, including filing with the Board a Joint Statement of Issues and describing the type of evidence that would be required to support a case dealing with the identified issues.

[7] The Parties undertook to provide their Statement of Issues (jointly or not) and a description of the corresponding type of evidence that would be necessary 60 days from the case management conference.

IV. Order

[8] The NoGs filed for 2024-2028 will apply (with necessary adjustments) to the entire tariff period.

[9] Parties shall file their Statement of Issues (jointly or individually) and description of types of corresponding evidence no later than Tuesday, April 1, 2025.

[10] A CMC will be convened shortly thereafter.
