Matters: SOCAN Tariff 25 – Satellite Radio Services (2019, 2020, 2021-2023, 2024-2026); Re:Sound Tariff 4 – Satellite Radio Services (2022-2024, 2025-2029); ARTISTI Satellite Radio Tariff (2018-2020, 2021-2023, 2024-2026)

I. Overview

  • [1] The Board is preparing to initiate a proceeding for the consideration of the above-mentioned matters.

  • [2] Prior to the initiation, the Board has several questions which will help determine the scope of the proceeding, and for which the parties’ input is sought.

  • [3] Parties shall provide written answers to the following questions, by no later than Wednesday, July 23, 2025.

II. Questions

[4] Questions for Artisti and ADISQ:

  1. Does Artisti intend to proceed with seeking the approval of its proposed tariffs? If not, please address proposed next steps and timeline.

  2. Does ADISQ, who objected to Artisti’s proposed tariff for 2018-2020, intend to participate in the proceeding?

[5] Questions for Re:Sound and SiriusXM:

  1. Has Re:Sound reached an agreement with SiriusXM regarding the simulcast portion of the proposed tariffs Re:Sound Tariff 8 – Simulcasting, Non-Interactive Webcasting and Semi-Interactive Webcasting for 2009-2012, 2013, 2014 and 2015, as well as the proposed tariff Re:Sound Tariff 4.B – Satellite Radio Simulcasts for 2016-2018?

  2. If not, please provide details of what else has been agreed upon, if anything, and what the next steps are together with a proposed timeline.

  3. Has Re:Sound reached an agreement with SiriusXM regarding the simulcasts of satellite radio for the years 2019-2021, which have been carved out from Re:Sound Tariff 4 – Satellite Radio Services (2019-2021), approved on December 7, 2024 ?

  4. If not, please provide details of what else has been agreed upon, if anything, and what the next steps are together with a proposed timeframe.

  5. Should the consideration of the simulcasts for both periods (2009-2018 and 2019-2021) proceed together?

  6. In addition, should the consideration of the proposed tariffs for both periods (2009-2018 and 2019-2021) be added to this proceeding?

[6] Question for SOCAN and SiriusXM:

1. Should the simulcast portion of SOCAN’s proposed Tariffs 22.B Internet Commercial Radio, Satellite Radio and Pay Audio for 2019, 2020, 2021-2023 and 2024-2026 be added to this proceeding? If not, is this because they are under negotiation or for some other reason?

[7] Question for Artisti and SiriusXM:

1. Should the simulcast portion of Artisti’s proposed tariffs for Online Music Services for 2023-2025 and 2026-2028 be added to this proceeding? What is the basis for the parties’ position?

[8] Question for Re:Sound, SOCAN, Artisti, ADISQ and SiriusXM:

1. Should the Board consolidate the consideration of the proposed tariffs for the three collectives in one proceeding? What are the parties’ views on the potential advantages/disadvantages of doing so? Please consider the potential impacts of the consolidation on the schedule, case management, and relative efficiencies of the proceeding.
