I. Proposed Tariffs to be Considered

[1] The Board is ready to commence proceeding PT25-04 – SOCAN Tariff 5.A – Exhibitions and Fairs (2025-2027) and SOCAN Tariff 5.B – Concerts at Exhibitions and Fairs (2022‑2024, 2025-2027) to consider the following proposed tariffs (the “Proposed Tariffs”) in a written hearing:

  • SOCAN Tariff 5.A – Exhibitions and Fairs for the years 2025-2027

  • SOCAN Tariff 5.B – Concerts at Exhibitions and Fairs for the years 2022-2024

  • SOCAN Tariff 5.B – Concerts at Exhibitions and Fairs for the years 2025-2027

II. Objectors

[2] No objections to the Proposed Tariffs have been filed.

IV. Interveners and Letters of Comment

[4] A person with an interest in this proceeding may file a request for intervener status as per Rule 52 of the Copyright Board Rules of Practice and Procedure; any person may file a letter of comment in the official language of their choice as per Rule 53.

V. Questions to SOCAN

A. Changes in the Proposed Tariffs compared to the Last Approved Tariffs

[6] SOCAN shall provide submissions to support the proposed rate increase in 5.B for the period 2022-2024.

[7] In addition, SOCAN shall provide evidence and arguments supporting the inclusion of a minimum fee in proposed tariff 5.B (2025-2027) as being fair and equitable.

[8] Specifically, SOCAN is required to provide the following market data to help estimate the number of users potentially affected by the inclusion of a minimum fee and the extent of the impact, if any.

[9] For each year 2022 to 2024, SOCAN shall provide:

  1. The number of Tariff 4.A users who paid the minimum fee, including the corresponding royalty revenues collected; and

  2. The number of Tariff 5.B users who would have paid less than the same minimum fee had it been in effect. In addition, provide the corresponding royalty revenues that would have been collected.

[10] For each year 2022 to 2024, SOCAN shall provide:

  1. The number of Tariff 4.A users who paid more than the minimum fee including the corresponding royalty revenues collected; and

  2. The number of Tariff 5.B users who would have paid more than the same minimum fee had it been in effect. In addition, provide the corresponding royalty revenues that would have been collected.

B. SOCAN Tariff 4.A.1 (2018-2024) as a proxy to SOCAN Tariff 5.B (2025-2027)

[11] Furthermore, SOCAN shall provide submissions explaining why the proposed minimum rate for SOCAN Tariff 5.B should be aligned with that of SOCAN Tariff 4.A.

[12] To assess whether the royalty structure and rates in SOCAN Tariff 5.B (2025-2027) can appropriately mirror those in the per event SOCAN Tariff 4.A, SOCAN is required to provide, for each year from 2022 to 2024, the following data for both tariffs:

  1. The total number of users;

  2. The total royalties collected;

  3. The average ticket price or net ticket price used to calculate the royalties owed; and

  4. The average number of operating days and average attendance.

C. Deadline and Final Day for Written Submissions

[13] SOCAN shall file the required information and any other evidence in support of its Proposed Tariffs by August 29, 2025.

[14] This day will constitute the final day on which any party may present their submission for the purposes of Time Limits in Respect of Matters Before the Copyright Board Regulations, SOR/2020-264.
