I. Proposed Tariffs to be Considered

[1] The Board is ready to commence proceeding PT25-05 – SOCAN Tariff 8 – Receptions, Conventions, Assemblies and Fashion Shows (2023-2028), to consider the following proposed tariffs (the “Proposed Tariffs”) in a written hearing:

• SOCAN Tariff 8 – Receptions, Conventions, Assemblies and Fashion Shows for the years 2023-2025

• SOCAN Tariff 8 – Receptions, Conventions, Assemblies and Fashion Shows for the years 2026-2028

II. Objectors

[2] Objections to the Proposed Tariffs have been filed by the following parties:

[3] At this time, should an objector decide not to participate in this proceeding, they must inform the Board and parties by August 5, 2025. For more information, see Practice Notice on Changing the Status of a Party (PN 2023-010).

III. Language of Proceeding

[4] Parties may address the Board and each other in the official language of their choice. Parties must confirm the official language in which they wish to participate in this proceeding by August 18, 2025.

[5] If a party anticipates that they will need to disclose confidential information in the course of this proceeding, they are invited to request a confidentiality order as soon as possible (see Rule 46 of the Copyright Board Rules of Practice and Procedure (the “Rules”)), in accordance with Practice Notice on Confidentiality Order (PN 2024‑013).

VI. Interveners and Letters of Comment

VII. Issues to be Considered

[9] Based on the Notice of Grounds for Objection filed by Hotel Association of Canada and Restaurants Canada for the 2026-2028 period, the Board understands that the issues to be addressed in this proceeding are:

1. Whether any inflation based-adjustments should be made;

2. If applicable, which methodology should be used to calculate the inflation-based adjustment;

3. Whether the combined impact of the rate increase, as proposed by SOCAN and Re:Sound, on users of the tariff should be accounted for; and

4. Whether to clarify the tariff scope in relation to live dance performances.

[10] Unless parties indicate otherwise, the Notice of Grounds for Proposed Tariff and for Objection filed for 2026-2028 will be considered for both tariff periods, and the parties will proceed on the basis of the four issues identified in Section VII.

[11] The Board proposes the following schedule of proceeding:

IX. Order

[12] No later than August 18, 2025, the parties shall inform the Board if they agree with the above-listed issues and with the proposed schedule of proceeding.

[13] Should they disagree with the list of issues, the parties must file a Statement of Issues (jointly, or individually if they cannot agree) and, if applicable, a joint proposed schedule of proceeding by August 25, 2025.
