I. Background

[1] Following Order CB-CDA 2025-036, the Parties participated in a technical meeting with Board Staff on June 19, 2025, to discuss the scope of submissions on the Panel’s preferred methodology and the intended expert reports.

[2] Order CB-CDA 2025-036 had also extended the initial deadline of May 21, 2025, for filing those submissions, as set by Order CB-CDA 2025-031.

[3] At this meeting, the Parties expressed concern that Order CB-CDA 2025-031 was not clear on what decision the Board would render following the requested submissions. In addition, SOCAN indicated that this order did not set out procedural steps for filing those submissions.

[4] The Parties undertook to file a joint request for additional guidance from the Board to address the questions raised during the technical meeting.

[5] On July 18, 2025, SOCAN filed submissions indicating that counsel to the Parties had engaged in discussions with a view to making a joint submission, but counsel to the Canadian Broadcasting Corporation (CBC) has not been able to obtain instructions as of the time of writing.

[6] Subsequently, CBC indicated that it made a “settlement” offer to SOCAN on July 30, 2025, and requested a two-week extension to file submissions on the additional guidance required with respect to Phase 1 of the present proceeding.

II. Order

[7] The request is granted. CBC shall file its submissions by August 15, 2025.
