I. Overview
[1] In Order CB-CDA 2025-059, I had ordered that SOCAN file its revised Request for Approval (RFA) for the reproduction Proposed Tariffs, and scheduled a Case Management Conference (CMC) to fix the next procedural steps in this proceeding.
[2] SOCAN filed its revised RFA on July 23, 2025.
[3] On August 6, 2025, the Parties jointly proposed that I cancel the CMC scheduled for August 8, 2025, and proposed a schedule pursuant to which they would make submissions on the procedural fairness of SOCAN’s revised Request for Approval.
II. Order
[4] The CMC of August 8, 2025 is cancelled.
[5] The Parties shall make submissions to the Panel on the issue of procedural fairness according to the following schedule:

[6] In their submissions, Parties shall address possible remedies to any identified procedural unfairness. This can include tariff structures that would reduce the likelihood that any royalties payable would be greater than those under the published Proposed Tariffs for reproduction.
