I. Background
[1] Following recent changes of personnel at FIC, I required FIC to provide clarification whether Andrea F. Rush remains FIC’s counsel in this proceeding (Order CB-CDA 2025-060).
II. Counsel representation

[2] In response, on July 30, 2025, FIC informed me that it will continue to be represented by the same firm, Blaney McMurtry LLP, and that their legal counsel team will include Mr. David Ullman in this proceeding.

[3] I am aware that counsel for FIC has not yet signed the Confidentiality Order’s undertaking and, as such, has not yet been provided with the highly confidential version of SOCAN’s submissions.

[4] FIC also wrote that it has “begun conversations [with SOCAN] with a mutual objective to resolve this matter amicably and would suggest that the action towards proceedings may pause for 6 weeks as we continue to discuss a resolution”.

[5] On July 31, 2025, FIC clarified that it was not jointly requesting a stay of proceeding. In response, SOCAN wrote to state its opposition to a six-week adjournment of the proceeding.

[6] SOCAN shall provide FIC’s counsel the highly confidential version of its May 26, 2025 submissions within 7 days of receiving a signed copy of the confidentiality undertaking. FIC will inform the Board when it has done so.

[7] Parties shall file with the Board, and serve on the other party, their respective response to the submissions filed pursuant to Board Order CB-CDA 2025-019 21 days after the signed confidentiality undertaking is provided to SOCAN.

[8] Parties may jointly request to stay the proceeding.
