I. Overview
[1] I held a Case Management Conference (CMC) on July 15, 2025, to discuss the procedural consequences of SOCAN’s letter of June 13, 2025.
[2] In regards to the next steps in this proceeding, SOCAN stated that
-
it intends to file a revised Request for Approval (RFA);
-
it is now of the view that a repertoire-use study would be required for the reproduction Proposed Tariffs;
-
certain filings that relate to repertoire-use (such as submissions on tariff structure) may have to be refiled or amended;
-
the Board would then rule on any outstanding requests, and on the issue of repertoire-use.
[3] For their part, the Objectors stated that some of those steps are premature and that the Objectors may raise issues of procedural fairness.
[4] To provide both the Parties and the Board with a better understanding of the possible consequences of the revised request, SOCAN will first file and serve its revised RFA before further procedural steps are fixed.
II. Overview
[5] As such, I order that:
-
SOCAN shall file a revised RFA for its reproduction Proposed Tariffs by Wednesday, July 23, 2025;
-
Parties are to discuss amongst themselves the appropriate next steps in this proceeding; and
-
a Case Management Conference will be held on or about the week of August 4, 2025, to fix the next procedural steps in this proceeding.
[6] Parties shall confirm their preference for the following times by Friday, July 25, 2025:
-
Thursday, August 7, 2025, at 11:00 a.m.;
-
Friday, August 8, 2025, at 1:30 p.m.; and
-
Monday, August 11, 2025, at 1:30 p.m.
