Proceeding: SOCAN Tariff 19 – Physical Exercises and Dance Instruction (2018-2022)

I. Counsel of Record

• [1] On March 10, 2025, following Order CB-CDA 2025-020, the Fitness Industry Council (FIC) stated that Andrea F. Rush “will serve as FIC’s legal representative in all matters related” in this proceeding. FIC also requested that all related communications be directed to Andrea F. Rush.

• [2] Following recent changes of personnel at FIC, the Board requires clarification whether Andrea F. Rush remains FIC’s counsel in this proceeding.

II. Confidentiality Order

• [3] On April 14, 2025, the Board issued Confidentiality Order CB-CDA 2025-028 (the Order). The Order states that information that is designated as highly confidential by one party may be seen only by the other parties’ external counsel. SOCAN filed submissions pursuant to the Order, with information designated as both confidential and highly confidential.

• [4] The Board is aware that Andrea F. Rush has not yet signed the Order’s confidentiality undertaking and, as such, has not yet been served the highly confidential version of SOCAN’s submissions.

IV. Order

• [5] By July 25, 2025, FIC shall inform the Board and SOCAN whether it is still represented in this proceeding by Andrea F. Rush. If so, that counsel must file with the Board and serve on SOCAN a signed confidentiality undertaking by the same date.

[6] SOCAN shall serve on FIC’s counsel the highly confidential version of its May 26, 2025, submissions within 7 days of receiving a copy of the confidentiality undertaking.
