Notice of the Board
Proceeding: Television Retransmission Tariff (2019-2028)

I. BACKGROUND
[1] A case management conference (CMC) was held on January 28, 2025, following Orders CB-CDA 2024-105 and CB-CDA 2025-006.
[2] The Board had proposed a three-phased approach where, in the first phase, a model for determining the royalty rate would be selected. However, there was a consensus among the Parties that a three-phased approach was not appropriate.
[3] The Parties indicated that, while the initial goal is proceeding efficiency, it was best to gather information on the state of the relevant market and assess how protected content is valued by users before selecting any methodology to determine the appropriate rate.
[4] In keeping with the goal of efficiency, the Parties proposed different ways to circumscribe the information-gathering process, including filing with the Board a Joint Statement of Issues (JSI) and describing the type of evidence that would be required to support a case dealing with the identified issues.
[5] As per Order CB-CDA 2025-013, on April 15, 2025, the Parties provided a JSI and a description of the corresponding type of supportive evidence that would be necessary.
II. July 10, 2025, Case Management Conference
[6] As per Notice CB-CDA 2025-043, the purpose of the upcoming CMC is to discuss the content of the JSI.
[7] I intend to:
· Ask the parties some questions on items 13 to 16 in the JSI, with a view to ensuring that the information sought is relevant and realistically available;
· Discuss the parameters for this information-gathering process;
· Discuss the next steps in this proceeding, including selecting a methodology to determine the appropriate rate, interrogatories pertaining to model-specific data, case records and hearing;
· Discuss timelines with a view to setting a Schedule of proceeding.
