Order of the Board

 

Proceeding: Television Retransmission Tariff (2019-2028)

I. Background

[1] Following Order CB-CDA 2025-052, a case management conference (CMC) was held on July 10, 2025, to discuss the next steps in the proceeding with the Parties.

[2] At the beginning of the CMC, I asked whether there were any disagreements on the Joint Statement of Issues (JSI). The Parties confirmed that there were none. Rather, some issues were less relevant or less important for some of the Parties.

[3] I then asked the Parties to confirm that no changes to the JSI were required as a result of the Federal Court of Appeal’s decision in Copyright Collective of Canada v. Bell Canada, 2025 FCA 92 — a judicial review of the Board’s reconsideration of the Tariff for the Retransmission of Distant Television Signals, 2014-2018. The Parties confirmed that no changes were required as a result of this decision.

[4] Finally, I asked the Parties about the data necessary to fix fair and equitable rates. I informed them that I wanted to order that certain data be filed and served on all Parties. As a result, the Parties made the following undertakings.

II. Undertakings

[5] The Parties undertook to

a) jointly commission Numeris and Mediastats studies;

b) file with the Board annotated issues 13 to 16 of the JSI, indicating sources of information for those issues;

c) finalize discussions on reference years and update the Board; and

d) file a joint, proposed schedule of proceedings.

III. Order

[6] In addition to the Parties’ undertakings, I order that—once complete—the Parties file the Numeris and Mediastats studies with the Board.

[7] To address the concern raised at the CMC by counsel for the CRRA that “data do not speak for themselves”, the group of Collectives and the group of Objectors may, each, file explanatory submissions for these studies—not to exceed 5 pages per study. These are to be filed within 5 days of the studies being filed with the Board.

[8] The Parties shall provide the Board with an update on the progress of completing all undertakings and the expected date for completion, including the expected time to complete and file the studies referred to in paragraph [6], no later than Friday, September 12, 2025.
