I. Overview

[1] On November 17, 2025, the Board ordered SOCAN and CBC to file their agreement(s) within two weeks of the signature of their confidentiality undertakings.[1] The confidentiality undertakings were signed on December 19, 2025.

[2] On January 2, 2026, SOCAN and CBC informed the Board that their agreement is settlement privileged and not producible, absent a valid waiver from CBC and SOCAN or other recognized exception. They seek a two-week extension to file the agreement or inform the Board that waivers were not secured.
II. Ruling
[3] The request is granted. CBC and SOCAN must file their agreement(s) or inform the Board regarding the settlement privilege status by no later than January 16, 2026.
[4] The granting of the extension does not, however, negate the original order to file the CBC-SOCAN agreement(s) nor amount to a recognition that settlement privilege applies in this case.
[5] Furthermore, SOCAN is reminded that under Order CB-CDA 2025-105 it must file other agreement regarding broadcasting-related copies that SOCAN has entered with the CAB, directly with a member of the CAB, or any other broadcaster. [2]
