[1] On December 3, 2025, the Board issued Notice and Order CB-CDA 2025‑117 which included questions to Re:Sound.

[2] On January 6, 2026, Re:Sound requested that the Board issue a Confidentiality Order in this proceeding prior to filing its response, which is due by January 14, 2026.
[3] Re:Sound attached a proposed Confidentiality Order in the form of the Board’s Confidentiality Order Template B.

[4] Subrule 46(6) of the Copyright Board Rules of Practice and Procedure states that:
Any document that is filed with the Board in relation to a matter and any related proceeding is placed on the public record, unless the document has been designated as confidential or highly confidential.
[5] As per rule 46, information may be designated as confidential or highly confidential once a confidentiality order has been issued in a proceeding.
[6] Since Re:Sound is the only party in the proceeding, Template B – which applies to sharing information between parties – is not applicable.
[7] That said, to preserve the confidentiality of the information Re:Sound intends to file in its response, the Board is issuing a confidentiality order, as Appendix 1.
[8] Re:Sound shall file a public and confidential version of its response in accordance with the Board’s Practice Notice on Filing of Documents (PN 2019‐001) by January 14, 2026.

Confidentiality Order
[1] This order applies to documents and information that Re:Sound designates as confidential or highly confidential in the above-mentioned proceeding.
[2] Re:Sound may file confidential or highly confidential information pursuant to this order.
[3] Information must be designated in accordance with the instructions provided in the Board’s Practice Notice on Filing of Documents (PN 2019‐001).
[4] This order does not in any way restrict Re:Sound from using documents or information that it has designated confidential or highly confidential.
[5] In the event that additional parties are added to this proceeding, Re:Sound may file a request with the Board to modify this Order.
