I. Background

[1] On January 20, 2026, as per Order CB-CDA 2025-115, SOCAN filed submissions in response to the Fitness Industry Council’s (FIC) amended submissions in response to Order CB-CDA 2025-019, received on January 8, 2026.

[2] SOCAN requests that the Board make use of 9(b) of the Copyright Board Rules of Practice and Procedure. SOCAN’s position is that the Board has the power under Rule 9(b) to protect the fairness and efficiency of this proceeding by deciding this matter on the record as it stands. The Board should use this power and approve the Proposed Tariffs, as proposed, without any further delay.

II. Order

[3] FIC shall provide its response by no later than Friday, February 13, 2026.
