I. Background
[1] On February 27, 2026, I received the Parties’ Joint Statement of Issues, in both official languages. In Order of the Board CB-CDA 2026-032, I asked the Parties to file a Joint Schedule of Proceeding, by April 1, 2026.
[2] On April 1, 2026, SiriusXM, with the consent of Artisti, wrote to the Board to request an order suspending the proceeding sine die (indefinitely), in light of the ongoing discussions between the Parties, to “exchange information with the goal of either simplifying or settling the matter.”
[3] SiriusXM advised that Parties would inform the Board should a material change in the circumstances occur, which would require the resumption of the proceeding, or its removal from the Board’s schedule.
II. Ruling
[4] The Board is generally not favourable to granting requests to suspend proceedings sine die. Given the Board’s duty to ensure that proceedings are moving forward but recognizing the Parties’ request to negotiate, the request to suspend the proceeding is granted in part.
[5] The Parties shall file a detailed update on the status of their negotiations, and any proposed next steps by no later than Monday, October 12, 2026.
